Article 11. Ensuring energy efficiency of buildings, structures, structures The Law on Energy Conservation and Energy Efficiency Improvement

     1. Designed and under construction (reconstructed, overhauled) buildings, structures, and structures must comply with the requirements of the legislation of the Republic of Kazakhstan on energy conservation and energy efficiency improvement.

     2. Energy efficiency requirements for buildings, structures, and structures should include:

     1) indicators characterizing the specific amount of energy consumption in a building, structure, or facility;

     2) requirements for architectural, spatial planning, technological, structural, and engineering solutions affecting the energy efficiency of buildings, structures, and structures;

     3) requirements for engineering systems and technological equipment used in buildings, structures, facilities;

     4) requirements for technologies and materials included in the design documentation and used in the construction (reconstruction, overhaul) of buildings, structures, and structures to eliminate irrational (unjustified) consumption of energy resources.

     Meeting energy efficiency requirements during the commissioning of buildings, structures, and structures is the responsibility of the developer.

     3. Energy efficiency requirements do not apply to the following buildings, structures, structures:

     1) buildings, structures, and structures that are classified as objects of historical and cultural heritage;

     2) temporary buildings for economic purposes, utility rooms, the service life of which is not more than two years;

     3) individual residential buildings, as well as buildings located on suburban and garden plots;

     4) detached buildings, structures, structures with a total area of less than fifty square meters;

     5) religious buildings, structures and structures;

     6) detached unheated buildings, structures and structures.

     4. The required energy efficiency class is indicated in the assignment for the development of a construction (reconstruction, overhaul) project and the cadastral passport of the real estate object when registering rights to real estate after the commissioning of the completed construction (reconstruction, overhaul) facility.

     5. The energy efficiency class of existing buildings, structures, and structures and its revision are established in accordance with the procedure determined by the authorized body based on the results of an energy audit and are indicated in the cadastral passport of the real estate object.

     The conclusion of the energy audit is attached to the cadastral passport of the real estate object (buildings, structures, structures).

     6. The marking of existing buildings, structures, and energy efficiency facilities is established based on the results of an energy audit and is indicated in the conclusion on energy conservation and energy efficiency improvement.

 

 

The Law of the Republic of Kazakhstan dated January 13, 2012 No. 541-IV.

     This Law regulates public relations and defines the legal, economic and organizational foundations of the activities of individuals and legal entities in the field of energy conservation and energy efficiency improvement.
