Article 11. Regulation of the use of the radio frequency spectrum and the orbital positions of communications satellites of the Communications Act
1. Regulation of the use of the radio frequency spectrum and the orbital positions of communications satellites is the exclusive competence of the State.
Regulation of the use of the radio frequency spectrum is carried out by the radio frequency authorities of the Republic of Kazakhstan and is a set of legal, economic, organizational and technical measures aimed at the effective use of the radio frequency spectrum and ensuring electromagnetic compatibility of radio electronic means and high-frequency devices, which is an integral part of the procedure for assigning (assigning) a frequency band, radio frequency (radio frequency channel).
The republican database of the radio frequency spectrum reflecting the electromagnetic situation in the Republic of Kazakhstan is maintained by the radio frequency authorities of the Republic of Kazakhstan.
The radio frequency spectrum is a national resource in the field of communications.
2. The development of proposals for the implementation of state policy in the field of distribution of the radio frequency spectrum, as well as the effective use of the radio frequency spectrum and the orbital positions of communications satellites in the interests of the state is carried out by radio frequency authorities.
3. The use of the radio frequency spectrum, which is a limited national resource, is carried out on a fee basis. Annual rates, the procedure for calculating and paying fees to the state budget for the use of the radio frequency spectrum are determined in accordance with the Tax Code of the Republic of Kazakhstan.
When radio frequencies and electronic means are used together to organize cellular communications, payment for the use of the radio frequency spectrum is made by each telecom operator for the frequency band assigned to it, the radio frequency (radio frequency channel) in accordance with the Code of the Republic of Kazakhstan "On Taxes and Other Mandatory Payments to the Budget" (Tax Code).
4. Excluded by the Law of the Republic of Kazakhstan dated 05.07.2011 No. 452-IV (effective from 13.10.2011).
5. Excluded by the Law of the Republic of Kazakhstan dated 07/10/2012 No. 36-V (effective after ten calendar days after its first official publication);
6. The level of industrial interference caused by radio-electronic devices and high-frequency devices should not exceed the standards established by technical regulations and standardization documents for these types of radio-electronic devices and high-frequency devices.
The external noise immunity of radio-electronic devices and high-frequency devices from industrial radio interference should not be lower than the standards established by technical regulations and standardization documents for these types of radio-electronic devices and high-frequency devices.
The Law of the Republic of Kazakhstan dated July 5, 2004 No. 567.
This Law establishes the legal basis for activities in the field of communications in the territory of the Republic of Kazakhstan, defines the powers of state bodies to regulate these activities, the rights and obligations of individuals and legal entities providing or using communications services.
