Article 12-1. Multimodal Transport Agreement of the Law on Transport in the Republic of Kazakhstan

Article 12-1. Multimodal Transport Agreement of the Law on Transport in the Republic of Kazakhstan

     1. A multimodal transport contract must contain:

     1) the rights and obligations of the customer (shipper, consignee, passenger, charterer) and the multimodal transport operator;

     2) the responsibility of the customer (shipper, consignee, passenger, charterer) and the multimodal transport operator;

     3) the procedure for filling in a single consignment note (single bill of lading);

     4) Delivery terms and conditions;

     5) Destinations;

     6) cargo volumes;

     7) cost and payment procedure.

     A multimodal transport contract may contain other conditions for the organization of multimodal transport that are not provided for by this Law and the rules of multimodal transport.

     2. The multimodal transport operator has the right to:

     1) to abandon the multimodal transportation of cargo, which, by its properties, weight and dimensional parameters, does not correspond to the cargo data specified in the multimodal transportation contract;

     2) in the event that it is not possible to deliver the cargo due to force majeure to a new destination specified by the customer (shipper, consignee, passenger, charterer), to abandon multimodal transportation and return the cargo to the shipper, having previously notified him about it. In this case, the additional costs of the multimodal transport operator are paid by the shipper (recipient), unless otherwise provided by the contract.;

     3) require the client (shipper, consignee, passenger, charterer) to properly fulfill obligations under the multimodal transport agreement.

     The multimodal transport operator has other rights established by the laws of the Republic of Kazakhstan and the multimodal transport agreement.

     3. The multimodal transport operator is obliged to:

     1) accept the cargo on time;

     2) organize cargo transportation using various modes of transport from the point of departure to the destination;

     3) ensure monitoring of cargo movement at each stage of transportation;

     4) ensure the safety of the cargo along the entire route;

     5) ensure the delivery of the goods on time;

     6) ensure that the cargo is delivered to the person authorized to receive the cargo (the recipient).

     The multimodal transport operator also bears other obligations established by the laws of the Republic of Kazakhstan and the multimodal transport agreement.

     4. The customer (the shipper, the recipient, the passenger, the charterer) has the right:

     1) get information about the route, composition and types of transport for the transportation of the declared cargo;

     2) require the multimodal transport operator to properly fulfill its obligations under the multimodal transport agreement;

     3) to claim compensation for damage caused during multimodal transportation upon presentation of written documentary evidence.

     The customer (shipper, recipient, passenger, charterer) has other rights in accordance with the laws of the Republic of Kazakhstan and the multimodal transport agreement.

     5. The customer (the shipper, the recipient, the passenger, the charterer) is obliged to:

     1) provide the cargo to the multimodal transport operator according to the deadline specified in the multimodal transport contract;

     2) pay to the multimodal transport operator all payments due, stipulated in the multimodal transport contract.

     The footnote. Section 3 is supplemented by Article 12-1 in accordance with the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective ten calendar days after the date of its first official publication).

 

The Law of the Republic of Kazakhstan dated September 21, 1994 No. 156.

     This Law defines the foundations of the legal, economic and organizational activities of transport in the Republic of Kazakhstan.
