Article 12-1. Organization of the activities of the State Commission The Law On the State of Emergency
1. The State Commission is formed from representatives of central and local executive bodies and commandants of localities where a state of emergency has been introduced. The personal composition of the State Commission is approved by the President of the Republic of Kazakhstan and depends on the circumstances that served as the basis for the introduction of the state of emergency. The State Commission consists of a chairman, members and a secretary. The Chairman of the State Commission is accountable to the President of the Republic of Kazakhstan.
The members of the State Commission and the specialists involved in ensuring its work retain their jobs and salaries at their main place of work.
1-1. When a state of emergency is imposed on the grounds in accordance with paragraph 2 of Article 3-2 of this Law, the Minister of Internal Affairs of the Republic of Kazakhstan is appointed Chairman of the State Commission.
Based on the analysis of the development of the situation, the President of the Republic of Kazakhstan has the right, at his discretion, to appoint a representative of any state body as chairman of the State Commission.
2. Meetings of the State Commission are convened by its chairman as necessary, and decisions are drawn up in minutes. Members of the State Commission participate in meetings without the right of substitution.
Decisions on each item on the agenda of the meeting are taken by open vote and are considered adopted if they are supported by a majority of votes from the total number of members of the State Commission. In case of equality of votes, the decision voted for by the chairman is considered adopted. Decisions taken by the State Commission in accordance with its competence are binding on the central and local executive bodies and commandant's offices of the locality where the state of emergency has been imposed, individuals and legal entities.
3. On issues within the competence of the President of the Republic of Kazakhstan, the State Commission submits relevant proposals, draft decrees and orders to the President of the Republic of Kazakhstan for consideration. On issues within the competence of the Government of the Republic of Kazakhstan, the State Commission submits relevant proposals, draft Government resolutions and orders of the Prime Minister of the Republic of Kazakhstan for consideration by the Government of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated February 8, 2003 No. 387.
This Law establishes the grounds, terms, procedure for the introduction and operation of a state of emergency throughout the territory of the Republic of Kazakhstan or in its individual localities, and the legal regime of a social emergency.
