It is not recognized as a violation of the exclusive right of the patent owner:

1) the use of facilities containing protected industrial property objects in the construction or operation of vehicles (sea, river, air, land and space) of other countries, provided that these facilities are temporarily or accidentally located on the territory of the Republic of Kazakhstan and are used for the needs of the vehicle. Such actions are not recognized as a violation of the exclusive right of the patent holder if the vehicles belong to individuals or legal entities of countries granting the same rights to owners of vehicles of the Republic of Kazakhstan.;

2) conducting scientific research or experiment on a facility containing a protected object of industrial property, if the purpose of such scientific research or experiment is not to generate income;

3) the use of such means in emergency circumstances (natural disasters, catastrophes, major accidents) with immediate notification to the patent holder and subsequent payment of adequate compensation to the patent holder;

4) the use of such funds to meet personal, family, household or other needs unrelated to entrepreneurial activity, if the purpose of such use is not to generate income.;

5) in emergency cases, one-time preparation of medicines in a pharmacy on a doctor's prescription;

6) importation into the territory of the Republic of Kazakhstan, application, offer for sale, sale, other introduction into civil circulation or storage for these purposes of funds containing protected objects of industrial property, if they were previously introduced into civil circulation in the territory of the Republic of Kazakhstan by the patent proprietor or another person with the permission of the patent proprietor.
