Article 12. Appointment and maintenance of special records of the Law on State Legal Statistics and Special Records

Article 12. Appointment and maintenance of special records of the Law on State Legal Statistics and Special Records

     1. Special accounting records are intended for information support:

      1) the activities of government agencies to improve the legislation of the Republic of Kazakhstan;  

      2) law enforcement activities of state bodies;  

      3) individuals and legal entities in accordance with the procedure established by the legislation of the Republic of Kazakhstan.  

      2. The authorized body ensures the collection, registration, processing, accumulation, systematization, classification, storage and use of special records.  

      3. The authorized body carries out the following types of special accounting:  

     1) persons who have committed criminal offenses, who have been and are being held criminally liable;

     2) fingerprint records of detainees, detainees and convicted persons;

      3) wanted persons who have absconded from the inquiry, investigation, court, as well as persons who evade serving their sentence or exercising probation control;

     4) Wanted and missing persons;

     5) bodies whose identity has not been established;

     6) persons brought to administrative responsibility;

     6-1) is excluded by the Law of the Republic of Kazakhstan dated 05.11.2022 No. 157-VII (effective ten calendar days after the date of its first official publication).  

     6-2) citizens of the Republic of Kazakhstan who have been brought to criminal responsibility, convicted and serving their sentences abroad;

     7) persons recognized by the court as legally incompetent and with limited legal capacity;

     8) persons deprived of the right to hold certain positions or engage in certain activities;

     9) persons who have committed corruption offenses;

     10) inspections, preventive control with visits to the subject (object) of control and supervision and other forms of state control, as well as supervision provided for by the laws of the Republic of Kazakhstan, registered with the authorized body in accordance with the procedure established by the legislation of the Republic of Kazakhstan;

     10-1) persons held accountable for carrying out terrorist activities, as well as organizations and information materials recognized by the court as terrorist;

     11) persons held accountable for committing extremism, as well as organizations and information materials recognized by the court as extremist;

     11-1) persons who have committed disciplinary offenses discrediting the civil service;

     IZPI's note!       Subparagraph 12) is provided for in the wording of the Law of the Republic of Kazakhstan dated 03.01.2023 No. 188-VII (effective from 01.01.2027).  

     12) persons dismissed from public service for negative reasons;

     13) road accidents that have caused death or injury to people;

     14) persons who have not fulfilled their obligations under the enforcement documents, as well as persons who have voluntarily failed to comply with the decision to impose an administrative fine;

     15) wanted persons who are debtors in enforcement proceedings, defendants in lawsuits filed in the interests of the state, as well as for the recovery of alimony, compensation for damage caused by injury or other damage to health, death of the breadwinner;

     16) persons held accountable for the legalization (laundering) of money and (or) other criminally obtained property, the financing of terrorism and the financing of the proliferation of weapons of mass destruction;

     16-1) persons brought to criminal responsibility for committing criminal offenses against the sexual integrity of minors;

      16-2) wanted persons who have lost contact with their relatives;  

     16-3) persons who are unable to provide installation information about themselves;

     17) amounts of confiscated property related to the legalization (laundering) of money and (or) other criminally obtained property, financing of terrorism and financing the proliferation of weapons of mass destruction, as well as amounts criminally obtained, subject to return and returned to the Republic of Kazakhstan;

     18) mutual legal assistance and other international requests related to the legalization (laundering) of money and (or) other criminally obtained property, the financing of terrorism and the financing of the proliferation of weapons of mass destruction.

     19) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);      

20) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication).  

     4. The rules for maintaining, using and storing special records, with the exception of operational and departmental records, are established by the authorized body.

 

 

The Law of the Republic of Kazakhstan dated December 22, 2003 No. 510.

      This Law defines the legal basis and principles for the implementation of state legal statistics and special accounting, the powers and functions of the authorized body, subjects of legal statistics and special accounting.
