Article 12. Competence of local executive bodies (akimats) of regions, cities of republican significance, the capital, districts, cities of regional significance of the Law on Tourism Activities in the Republic of Kazakhstan

1. The local executive body of the region, the city of republican significance, the capital:

1) implements state policy and coordinates tourism activities in the territory of the relevant administrative-territorial unit;

2) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

3) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

4) excluded by the Law of the Republic of Kazakhstan dated 07/15/2011 No. 461-IV (effective from 01/30/2012).

5) excluded by the Law of the Republic of Kazakhstan dated December 29, 2014 No. 269-V (effective from 01.01.2015);

6) analyzes the market of tourist services and submits to the authorized body the necessary information on the development of tourism in the territory of the relevant administrative-territorial unit;

7) develops and implements measures to protect regional (cities of republican significance, the capital) tourist resources;

8) coordinates the planning and construction of tourism industry facilities on the territory of the relevant administrative-territorial unit, with the exception of the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

9) provides assistance in the activities of children's and youth camps, tourist associations;

10) provides methodological and advisory assistance to subjects of tourist activity in matters related to the organization of tourist activities, with the exception of subjects operating in the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

11) develops and supports entrepreneurship in the field of tourism activities as a measure to increase employment, with the exception of entrepreneurship carried out in the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

11-1) carries out state control over compliance with the legislation of the Republic of Kazakhstan on tourism activities;

12) provides tourist information, including on the tourism potential, tourism facilities and persons engaged in tourism activities;

13) establishes a tourist information center;

13-1) carries out licensing of tour operator activities in accordance with the Law of the Republic of Kazakhstan "On Permits and Notifications";

13-2) organizes professional training of guides, guides and instructors of tourism, with the exception of guides, guides and instructors of tourism operating in the territory of a city of regional significance with a special status in accordance with the Law of the Republic of Kazakhstan;

13-3) approves, in agreement with the authorized body, an action plan for the development of the tourism industry.;

13-4) maintains the state register of tourist routes and trails;

13-5) creates tourism infrastructure on the territory of the relevant administrative-territorial unit, takes measures for the construction and development of tourism facilities capable of meeting the needs of tourists, with the exception of the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

13-6) creates conditions for subjects of tourist activity in the development of tourism;

13-17) monitors the non-alienation and targeted use of visitor centers, tourist accommodations, equipment and equipment for ski resorts, roadside service facilities, motor vehicles with a capacity of more than eight seats, with the exception of the driver's seat, for five years from the date of receipt by the business entity of reimbursement of part of the costs, as well as the functioning of sanitary facilities.hygiene units during the period of receiving subsidization of part of the costs, including tourism facilities and business entities, operating in the territory of a city of regional significance with a special status in accordance with the Law of the Republic of Kazakhstan;

13-18) defines the boundaries of priority tourist areas;

13-19) ensures the inclusion of directions and measures for the development of domestic and inbound tourism in the development plans of the region, the city of republican significance and the capital, developed within the framework of the documents of the State Planning System of the Republic of Kazakhstan.;

13-10) implements measures for the construction, reconstruction, repair and maintenance of access roads of regional and district significance to tourist accommodation located outside populated areas;

13-11) reimburses part of the costs of business entities for the construction of roadside service facilities, with the exception of roadside service facilities located in the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

13-12) subsidizes part of the costs of business entities for the maintenance of sanitary and hygienic units, with the exception of sanitary and hygienic units located in the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

13-13) reimburses part of the costs of purchasing motor vehicles with a capacity of more than eight seats, excluding the driver's seat, to business entities engaged in tourism activities, with the exception of motor vehicles purchased by business entities engaged in tourism activities in the territory of a city of regional significance with a special status, in accordance with the Law of the Republic of Kazakhstan;

13-14) organizes the design, construction and maintenance of engineering infrastructure (roads, bridges, power transmission lines and other communications) to tourism facilities located in specially protected natural territories of national and local significance, as well as to tourism facilities and tourist accommodations located outside populated areas, taking into account the migration routes of animals without providing land use rights or private property rights;

13-15) subsidizes the costs of tour operators in the field of inbound tourism for each foreign tourist;

13-16) reimburses part of the costs of business entities for the purchase of equipment and equipment for ski resorts;

14) exercises, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

2. Local executive body of the district, city of regional significance:

1) implements state policy and coordinates tourism activities in the territory of the relevant administrative-territorial unit;

2) collects, analyzes and provides to the local executive body of the region, the city of republican significance, the capital information on the development of tourism in the territory of the relevant administrative-territorial unit;

3) develops and implements measures to protect regional tourist resources;

4) coordinates the planning and construction of tourism industry facilities on the territory of the relevant administrative-territorial unit;

5) provides assistance in the activities of children's and youth camps, tourist associations;

6) provides tourist information, including on the tourism potential, tourism facilities and persons engaged in tourism activities;

6-1) maintains a register of tourist routes and trails in the area;

7) exercises, in the interests of local government, other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated June 13, 2001 No. 211.

This Law defines the legal, economic, social, and organizational foundations of tourism activity as one of the sectors of the economy of the Republic of Kazakhstan.
