2. The competence of the authorized state body for highways includes:

1) (excluded)

2) formation and implementation of a unified state and scientific and technical policy in the field of highways and road activities;

2-1) coordination and methodological guidance of local executive bodies in the field of highways and road activities;

2-2) coordination and implementation of a unified state policy in the field of highways and road activities in the territory of the Republic of Kazakhstan;

3) state registration of public roads;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

4) development of proposals to determine the sources and amounts of financing for the road industry in accordance with the legislation of the Republic of Kazakhstan;

5) state planning of the development of public roads in accordance with the objectives of strengthening the economy and defense capability of the Republic of Kazakhstan;

6) participation in the conclusion of international agreements of the Republic of Kazakhstan regarding the development and operation of highways;

7) development of draft regulatory legal acts defining the functioning of the road sector, regardless of the forms of ownership, as well as national standards in road activities, criteria for prioritizing projects for the construction and reconstruction of highways of international and national significance and for the construction, reconstruction, as well as capital and medium repairs of highways of regional and district significance;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

7-1) development and approval of rules for the implementation and financing of construction, reconstruction, repair, maintenance, diagnostics, certification and instrumental inspection of public roads of international and national importance;

7-2) consideration of draft standardization documents within the scope of competence, as well as preparation of proposals for the development, amendment, revision and cancellation of national, interstate standards, national classifiers of technical and economic information and recommendations on standardization for submission to the authorized body in the field of standardization;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

8) preparation of scientifically based standards for financing the costs of repair and maintenance of highways;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

8-1) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective ten calendar days after the date of its first official publication);

9) excluded by the Law of the Republic of Kazakhstan dated 07/02/2013 No. 112-V (effective after ten calendar days after its first official publication);

10) coordination of activities for the creation and development of a network of highways of regional and district significance for general use;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

11) implementation of investment and social policy in the road sector;

13) conducting scientific research in the field of road activity;

14) financing of the National Operator within the framework of the state assignment;

14-1) organization of an expert examination of the quality of works and materials during the construction, reconstruction, repair and maintenance of highways by the National Center for the Quality of Road Assets aimed at the development of transport infrastructure;

14-2) financing of works and services of the National Center for Quality of Road Assets in accordance with the budget legislation of the Republic of Kazakhstan;

15) ensuring compliance with norms and national standards adopted in the field of design, required quality in the construction, reconstruction, repair and maintenance of highways;

16) development of proposals for the transfer of sections of highways (bridge crossings) for the implementation of a public-private partnership project, the procedure and conditions of their operation, and the amount of fares for them;

21) implementation and expansion of international cooperation on the construction, repair and maintenance of highways;

22) management of road activities carried out for the purpose of ensuring the development, safety, repair and maintenance of highways;

24) approval of regulatory and technical documents in the field of highways;

25) approval of the classification of types of work performed during maintenance, current, medium and major repairs of highways and management of road assets;

26) conclusion of a lease agreement as a lessee, as well as a service agent agreement as a service agent, as well as other agreements regarding republican public roads or their sections in accordance with the terms of the issue of state Islamic securities;-Excluded by the Law of the Republic of Kazakhstan dated June 24, 2026 No. 324-VIII SAM

27) coordination of the development of roadside service facilities on public roads of national importance;

27-1) approval of the roadside service facilities development plan;

27-2) approval of the rules for holding tenders for the construction of roadside service facilities built without attracting budgetary funds;

28) development and approval of the procedure and conditions for classification, list, names and indexes of public roads of international and national significance, including the list of defense-use highways;

29) making a decision on the use of a public highway (section) of international and national significance on a paid basis;

30) development and approval of rules for the use of highways, roads of defense significance;

31) development and approval of financing standards for the repair, maintenance of public roads of international and national importance and management of road activities;

32) development and approval of the procedure for payment and rates of tolls for travel through the territory of the Republic of Kazakhstan of motor vehicles;

33) development and approval of the procedure and operating conditions for toll roads and public bridge crossings of international and national importance;

34) excluded by the Law of the Republic of Kazakhstan dated 08.01.2019 No. 215-VI (effective three months after the date of its first official publication);

36) development and approval of rules for the organization of quality assessment of works and materials by the National Center for Quality of Road Assets;

36-1) development and approval of rules for conducting departmental expertise of technical documentation for average repair of highways;

36-2) development and approval of rules for monitoring the safety of the road infrastructure of highways;

37) development and approval of Rules for the implementation and financing of construction, reconstruction, repair, maintenance, diagnostics, certification and instrumental inspection of public roads of international and national importance;

38) approval of financing standards for the repair and maintenance of streets of the capital, cities of republican significance, highways of regional and district significance;

38-1) development and approval of a methodology for determining the cost of works and services for the production of quality expertise of works and materials, as well as the management of road assets of highways;

39) organization of work on the development of feasibility studies, diagnostics and certification of highways of international and national importance, as well as improvement of the regulatory and technical base of the road industry in accordance with the legislation of the Republic of Kazakhstan on public procurement and in the field of public-private partnership;

40) organization of work on the repair and maintenance of public roads of international and national significance and toll roads (sections) in accordance with the budget legislation of the Republic of Kazakhstan;

41) organization of work on monitoring the safety of the road infrastructure of public roads of international and national importance;

42) development and approval of rules for the formation and maintenance of a digital highway repair planning system;

42-1) approval of the rules for the formation and maintenance of a unified database of road construction materials and new technologies;

42-2) approval of the procedure for mandatory professional development of employees of the road industry

43) organization of work on departmental expertise of technical documentation for average repair of highways.

44) approval of regulatory legal acts in the field of highways and road activities in accordance with the purpose and objectives of this Law and the legislation of the Republic of Kazakhstan;

45) approval of the rules for planning and selecting projects for financing the construction, reconstruction and repair of highways based on diagnostic and instrumental examination results;

46) approval of the rules for certification of highways;

47) development and approval of rules for the functioning, content and use of the digital platform of road assets;

This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
