Article 12. Grounds for refusing to grant refugee status to an asylum seeker under the Refugee Act

Article 12. Grounds for refusing to grant refugee status to an asylum seeker under the Refugee Act

     The following circumstances are grounds for refusing to grant refugee status to an asylum seeker:

     1) the absence of reasonable fears that a person may become a victim of persecution on the basis of race, nationality, religion, citizenship, membership in a particular social group or political beliefs;

     2) if a person refuses to report or knowingly provides false information about himself and the circumstances of his arrival in the territory of the Republic of Kazakhstan, as well as presents false documents;

     3) the person has the citizenship of a third state, the protection of which he can use;

     4) if the person arrived directly from the territory of a secure third country;

     5) if there are good reasons to believe that this person participates or participated in the activities of terrorist, extremist, as well as prohibited religious organizations operating in the country of nationality or in the country from which he came;

     6) if there are compelling reasons to believe that the person has committed a crime against peace, a war crime, or a crime against humanity as defined in international instruments concluded with a view to taking action against such crimes.;

     7) if there are compelling reasons to believe that this person has committed a serious crime of a non-political nature outside the Republic of Kazakhstan before arriving on its territory;

     8) if there are compelling reasons to believe that this person is guilty of committing acts contrary to the purposes and principles of the United Nations and international organizations of which Kazakhstan is a member.;

     9) if the person is protected or assisted by United Nations bodies or agencies other than the Office of the United Nations High Commissioner for Refugees;

     10) refusal to undergo or non-passage of fingerprint registration by this person in accordance with the legislation of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated December 4, 2009 No. 216-IV.

     This Law defines the legal status of asylum seekers and refugees in the territory of the Republic of Kazakhstan.
