Article 12. Obligations of producers of petroleum products of the Law On State Regulation of Production and Turnover of Certain Types of Petroleum Products

1. Producers of petroleum products are obliged to:

1) to carry out the sale of petroleum products on equal access and non-discrimination, unless otherwise provided by this Law;

2) prior to the start of production of petroleum products, send to the appropriate territorial subdivision of the authorized body in the field of turnover of petroleum products an application for assignment of a personal identification number-code in accordance with the rules approved by the authorized body in the field of turnover of petroleum products;

3) to produce and carry out the wholesale sale of petroleum products, taking into account the requirements of this Law;

6) submit for approval to the authorized body in the field of production of petroleum products the annual schedule of scheduled preventive maintenance of technological installations and comply with this schedule;

7) submit to the authorized body in the field of production of petroleum products primary statistical data or primary administrative data necessary for departmental statistical monitoring or administrative accounting;

8) provide oil suppliers with equal access conditions to the processing of crude oil and (or) gas condensate, and (or) refined products;

9) Excluded by the Law of the Republic of Kazakhstan dated 12/30/2021 No. 96-VII (effective sixty calendar days after the date of its first official publication).

10) to ensure equal access to oil suppliers, as well as to purchase and accept for processing crude oil, gas condensate, and refined products (with the exception of producers of low-capacity petroleum products) in the presence of documents confirming their origin specified in part two of paragraph 5 of Article 18 of this Law.;

11) keep records of the volumes of process fuel used for technological needs;

12) to purchase from oil suppliers process fuels obtained during the processing of feedstock and used for technological needs.

2. The obligations stipulated in subitems 6), 8), 11) and 12) of paragraph 1 of this article do not apply to producers of low-capacity petroleum products.

3. Producers of petroleum products are prohibited from:

1) to sell crude oil and (or) gas condensate, and (or) refined products obtained (purchased) for the purpose of their processing;

2) to produce gasoline and diesel fuel using metal-containing additives (iron, manganese, lead and others, except for antistatic additives for diesel fuel);

2-1) to carry out the sale and (or) shipment of substandard petroleum products;

3) use the same equipment for the production of petroleum products by two or more producers of petroleum products;

4) purchase and accept for processing crude oil and (or) gas condensate, and (or) refined products; in the absence of the documents specified in subitems 1) and 2) of paragraph 5 of Article 18 of this Law;

4-1) to produce petroleum products without a production passport approved in accordance with the established procedure;

5) to stop the operation of technological installations used for the production of petroleum products, without coordination with the authorized body in the field of production of petroleum products, except in cases where it is necessary to immediately prevent an emergency situation;

6) to produce petroleum products, with the exception of road bitumen, without equipping tanks with control metering devices or with faulty control metering devices and (or) control metering devices that do not automatically transmit information on the volume of production of petroleum products to the authorized body in the field of turnover, as well as to the authorized body in the field of production of petroleum products;

7) to carry out the sale (shipment) of certain types of petroleum products, with the exception of road bitumen, from the tanks of the production facility of the producer of petroleum products without moving petroleum products through control metering devices.

4. The prohibition provided for in subparagraph 5) of paragraph 3 of this article does not apply to producers of low-capacity petroleum products.

This Law regulates public relations arising in the process of production and turnover of certain types of petroleum products: gasoline, aviation and diesel fuel, fuel oil, road bitumen.
