Article 12. Powers of the authorized state body of the relevant industry The Law On Concessions is excluded by the Law of the Republic of Kazakhstan | Kyrgyz Republic Zanymen alynyp tastaldy.

Authorized state body of the relevant industry:

1) prepares an industry opinion on the tender (auction) documentation of the concession project in accordance with the rules approved by the authorized body for state planning;

2) is the organizer of a tender (auction) in respect of concession facilities belonging to republican ownership and provided for in paragraph 2 of Article 16 of this Law;

3) on the basis of a decision of the commission on concessions (hereinafter referred to as the commission) in respect of objects belonging to republican ownership, conclude a concession agreement for concession objects belonging to republican ownership and provided for in paragraph 2 of Article 16 of this Law;

4) monitors the implementation of concession projects and sends the monitoring results to the authorized state planning body for the assessment of the implementation of the concession project;

5) provides information to the authorized state body for the exercise of the right to dispose of republican property under concluded concession agreements;

6) organizes the transfer of facilities created on the basis of concession agreements to republican ownership;

7) organizes the attraction of new concessionaires by holding an open tender (auction) at the choice of the concessionaire in case of early termination of the previously concluded concession agreement on concession facilities belonging to republican ownership;

8) engages, if necessary, legal entities in advisory support of concession projects, the financing of which is carried out in accordance with the budget legislation of the Republic of Kazakhstan;

9) performs other functions stipulated by this Law, other laws, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated July 7, 2006 No. 167.

This Law defines the legal conditions of the concession, the types of state support for the concessionaire, and regulates public relations arising in the process of concluding, executing, and terminating concession agreements.
