Article 12. Requirements for food safety and measures to ensure it Chapter 4. REQUIREMENTS FOR FOOD SAFETY of the Food Safety Act

      1. The requirements for food safety and the processes (stages) of its development (creation), production (manufacture), turnover, disposal and destruction established by the legislation of the Republic of Kazakhstan on food safety are mandatory for the subjects.  

      2. Food safety is ensured by:  

     1) compliance by subjects with the requirements established by the legislation of the Republic of Kazakhstan on food safety;

     2) carrying out by the subject of production control over the compliance of the processes (stages) of development (creation), production (manufacture), turnover and disposal of food products with the requirements established by the legislation of the Republic of Kazakhstan on food safety;

     3) confirmation of compliance of food products with the requirements established by the legislation of the Republic of Kazakhstan in the field of technical regulation;

      4) conducting sanitary-epidemiological and veterinary-sanitary expertise;  

      5) the application of state regulatory measures in the field of food safety.  

      3. The processes (stages) of development (creation), production (manufacture), turnover, disposal and destruction of food products are carried out in coordination with authorized bodies.  

      4. Food products that do not meet the requirements established by the legislation of the Republic of Kazakhstan on food safety according to one of the following indicators are not allowed to be used in the processes (stages) of production (manufacture), turnover and disposal:  

      1) has obvious signs of poor quality (spoilage, decomposition, contamination);  

      2) exceeds radiological, toxicological, chemical and (or) microbiological standards;  

      3) has no documents certifying its safety and confirming its origin;  

     4) has no established shelf life or expired shelf life, with the exception of food products stored in the state material reserve and subject to disposal in the order of disposal;

      5) does not have a label containing information provided for by the legislation of the Republic of Kazakhstan on food safety;  

      6) does not correspond to the information provided;  

      7) it is a counterfeit food product.  

      5. The turnover of genetically modified objects and biologically active food additives is allowed only after a scientifically substantiated confirmation of their safety, which is carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan, and their state registration.  

 

 

The Law of the Republic of Kazakhstan dated July 21, 2007 No. 301.

      This Law establishes the legal basis for ensuring food safety to protect human life and health, the legitimate interests of consumers and environmental protection in the territory of the Republic of Kazakhstan.
