Article 12. Tariffs and payment of the Railway Transport Act
1. Prices for the services of the National Infrastructure Operator and railway track services with railway transport facilities under public-private partnership agreements are set in accordance with the legislation of the Republic of Kazakhstan.
2. The authorized body sets the maximum levels of prices (tariffs) for passenger transportation services for socially significant inter-regional communications. Local executive bodies set maximum price levels (tariffs) for passenger transportation services for socially significant inter-district (intercity, intra-regional) and suburban communications.
2-1. The expenses of the carrier providing passenger transportation services for socially significant messages along the entire route are subsidized from budget funds in accordance with the budget legislation of the Republic of Kazakhstan.
2-2. Interest rates for lending and financial leasing for the purchase of wagons, locomotives and modernization of railway tracks are subsidized from budget funds for the entire term of lending or financial leasing in accordance with the legislation of the Republic of Kazakhstan.
3. The rules for the application of the tariff (freight charge) for transportation in international traffic are established by international treaties of the Republic of Kazakhstan.
4. It was valid until 01.01.2022 in accordance with the Law of the Republic of Kazakhstan dated 27.12.2019 No. 295-VI.
5. The temporary balancing fee is set by the state body responsible for managing the relevant areas of natural monopolies when setting price limits for locomotive traction services and is sent to:
1) the operator of locomotive traction in passenger traffic;
2) The National Infrastructure Operator.
The rules for calculating and paying the temporary balancing fee are developed and approved by the state body responsible for managing the relevant areas of natural monopolies, in coordination with the authorized body.
The rules for calculating and paying a temporary balancing fee contain a list of expenses that are taken into account when forming a temporary balancing fee.
The source of the temporary balancing fee is the income of the National Cargo Carrier from the activities of transporting goods by rail in transit through the territory of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated December 8, 2001 No. 266.
This Law regulates public relations between carriers, participants in the transportation process, government agencies, passengers, senders, recipients, shippers, consignees, and other individuals and legal entities when transporting passengers, baggage, cargo, baggage, and mail by rail.
