Article 122. The cash control account of a territorial body and the current account of a private bailiff of the Law on Enforcement Proceedings and the Status of Bailiffs
1. For temporary storage of recovered amounts in favor of recoverers and other amounts intended for interested parties, including advance amounts for reimbursement of execution costs:
1) the territorial body opens control accounts in the central authorized body for the execution of the budget for the temporary placement of money in national and foreign currencies;
2) a private bailiff must have appropriate current accounts in national and, if necessary, in foreign currencies.
2. The money held in cash control accounts and a current account intended for storing recovered amounts in favor of recoverers is not the funds of a territorial authority or the income of a private bailiff. In the event of the death of a private bailiff, the money in the specified current account is not included in the estate.
3. A private bailiff shall open the following current accounts with a bank or an organization engaged in certain types of banking operations:
1) to store the collected amounts in favor of the recoverers;
2) for crediting payments for their activities, making payments for the maintenance of the office, paying salaries to office employees and other operations not covered by the current account intended for storing the collected amounts in favor of the recoverers.
At the same time, a private bailiff opens only one current account in the appropriate currency in a bank or an organization engaged in certain types of banking operations, designed to store the collected amounts in favor of the recoverers.
Transactions on this account are carried out exclusively in non-cash form.
