Article 13-1. Leadership of the Anti-terrorist Operation of the Law on Combating Terrorism

     1. Depending on the scale and degree of public danger and the expected negative consequences of an act of terrorism, the anti-terrorist operation is led by the head of a republican or regional city of republican significance, the capital, the district (city of regional significance) and the naval operational headquarters.

     2. From the beginning of the anti-terrorist operation until its completion, the head of the operational headquarters becomes its head and chief for all military personnel, employees and specialists of state bodies of the Republic of Kazakhstan involved in its conduct. In accordance with international treaties ratified by the Republic of Kazakhstan, the head of the operational headquarters becomes the head of the special forces units of foreign countries involved in the anti-terrorist operation.

     In social emergencies caused by mass riots; interethnic and interfaith conflicts; the blockade or seizure of certain areas, particularly important and strategic facilities; the organization and activities of illegal armed groups, the decision to conduct an anti-terrorist operation is made after coordination with the republican and (or) regional operational headquarters established to prevent and eliminate emergencies. of a social nature.

     3. In a state of emergency, the decision to conduct an anti-terrorist operation is made after coordination with the State Commission for Ensuring the State of Emergency under the President of the Republic of Kazakhstan or the commandant of the area.

     4. Upon receiving confirmed information about the committed act of terrorism or its preparation, as well as the beginning of an anti-terrorist operation, the head of the republican operational headquarters shall immediately inform the President of the Republic of Kazakhstan, the Security Council of the Republic of Kazakhstan, the Prosecutor General of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

     5. Unlawful interference by another official, regardless of his position, in the operational management of an anti-terrorist operation is prohibited.

     6. Head of the Operational Headquarters:

     1) determines the boundaries of the area, the time of the start and completion of the anti-terrorist operation, decides on the directions and limits of the use of the assigned forces and means.

     At the same time, depending on the scale and degree of public danger, the expected negative consequences of an act of terrorism, coordinates these decisions with the republican or regional operational headquarters established to prevent and eliminate a social emergency, in a state of emergency – with the State Commission for Ensuring the State of Emergency under the President of the Republic of Kazakhstan or the commandant of the area.;

     2) determines the representative of the operational headquarters responsible for maintaining contact with representatives of the media and the public;

     3) makes a decision and issues a combat order (combat order) to conduct an anti-terrorist operation.

     7. Responsibilities for coordinating the conduct of an anti-terrorist operation provided for in paragraphs 2, 3 and subparagraph 1) paragraph 6 of this article does not apply to anti-terrorist operations to ensure the safety of protected persons.
