Article 13. Arbitrators The Law on Arbitration

     1. An individual who is not directly or indirectly interested in the outcome of the case, who is independent of the parties and has consented to perform the duties of an arbitrator, has reached the age of thirty, has a university degree and has at least five years of professional experience, is elected (appointed) as an arbitrator.

     An arbitrator who resolves a dispute alone must have a higher legal education. In the case of collective dispute resolution, the chairman of the arbitral tribunal must have a higher legal education.

     By agreement of the parties, a citizen of the Republic of Kazakhstan, a foreigner or a stateless person may be elected as an arbitrator.

     2. Additional requirements for candidates for arbitrators may be agreed upon by the parties directly or determined by the rules of permanent arbitration.

     3. The arbitrator may not be a person:

     1) elected or appointed by a judge in accordance with the procedure established by the law of the Republic of Kazakhstan;

     2) recognized by a court in accordance with the procedure established by the law of the Republic of Kazakhstan as legally incompetent or with limited legal capacity;

     3) having an outstanding or outstanding criminal record;

     4) who is a civil servant, a deputy of the Parliament of the Republic of Kazakhstan, a deputy of the Maslikhat, carrying out his activities on a permanent or exempt basis, paid at the expense of the state budget, and a military man.

 

 

The Law of the Republic of Kazakhstan dated April 8, 2016 No. 488-V SAM.

     This Law regulates public relations arising in the course of arbitration activities in the territory of the Republic of Kazakhstan, as well as the procedure and conditions for the recognition and enforcement of arbitral awards in Kazakhstan.
