1. An industry trade union is the authorized representative of employees and affiliated organizations in social partnership at the industry level.

2. A branch trade union must have structural divisions and (or) affiliated organizations in a territory that includes more than half of the number of regions, cities of national significance and the capital.

Employees of small business entities have the right to form an industry trade union if there are structural divisions and affiliated organizations in the territory that includes more than half of the number of regions, cities of national significance and the capital.

2-1. In order to participate in the work of the sectoral commission on social partnership and regulation of social and labor relations, the sectoral trade union must notify the authorized state body of the relevant field of activity.

3. A branch trade union has the right to join the republican association of trade unions as a member organization subject to compliance with the charter of the republican association of trade unions.

4. The main functions of the branch trade union:

1) to represent and protect the labor and social rights and interests of its members and affiliated organizations;

2) to promote the development of the social partnership system at the sectoral level;

3) to act as a party to the social partnership when concluding an industry agreement with authorized representatives of industry employers' organizations and central government agencies of the Republic of Kazakhstan, to participate in negotiations on the preparation of a draft agreement and its conclusion;

4) participate in the work of the sectoral commission on social partnership and regulation of social and labor relations;

5) perform other functions aimed at achieving the statutory goals.

5. Branches and representative offices of a branch trade union are authorized representatives of employees to negotiate at the regional level on behalf of and within the authority of the branch trade union.

This Law regulates public relations resulting from the exercise by citizens of the constitutional right to freedom of association, the creation, operation, reorganization and liquidation of trade unions.
