1. The competence of regional (cities of republican significance, the capital) and district (cities of regional significance) representative bodies in the field of highways and road activities includes:

1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

2) hearing reports from the heads of regional (cities of republican significance, the capital) and district (cities of regional significance) executive bodies on the development and maintenance of public roads of regional and district significance, streets of settlements;

3) exercising other powers in accordance with the legislation of the Republic of Kazakhstan to ensure the rights and legitimate interests of citizens.

1-1. The regional (cities of republican significance, the capital) executive bodies in the field of highways and road activities include:

1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

1-1) implementation of state policy in the field of highways and road activities;

2) organization of works on construction, reconstruction, repair and maintenance of public roads of regional significance, streets in the city of republican significance, the capital in accordance with the legislation of the Republic of Kazakhstan on public procurement;

2-1) construction, reconstruction, repair and maintenance of access roads of regional significance to tourist facilities located outside populated areas;

3) management of the network of public roads of regional importance, streets of settlements;

4) management of roads and road enterprises owned by the municipal authorities of the region (cities of republican significance, the capital);

5) implementation of state control during the construction, reconstruction, repair and maintenance of highways of regional significance, streets in the city of republican significance, the capital;

5-1) organization of an expert examination of the quality of works and materials during the construction, reconstruction, repair and maintenance of highways of regional, district significance and streets of settlements by the National Center for the Quality of Road Assets;

5-2) financing of works and services of the National Center for Quality of Road Assets in accordance with the legislation of the Republic of Kazakhstan;

6) making a decision on the provision of public roads of regional significance or their sections for gratuitous temporary use;

6-1) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective after ten calendar days after the date of its first official publication);

6-2) approval of the procedure and conditions for the classification of public roads of regional and district significance;

6-3) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective after ten calendar days after the date of its first official publication);

6-4) excluded by the Law of the Republic of Kazakhstan dated 08.01.2019 No. 215-VI (effective three months after the date of its first official publication);

6-5) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective after ten calendar days after the date of its first official publication);

6-6) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective after ten calendar days after the date of its first official publication);

6-7) excluded by the Law of the Republic of Kazakhstan dated 27.10.2015 No. 363-V (effective after ten calendar days after the date of its first official publication);

6-8) approval of the classification of types of work performed during maintenance, current, average and major repairs of streets of settlements;

6-9) issuance of technical specifications for the design of channels, communication and power transmission lines, oil pipelines, gas pipelines, water pipes and railways, other engineering networks, communications, as well as for the construction of access roads and junctions to public roads of regional and district significance.;

6-9) coordination of the construction of access roads and junctions to public roads of regional and district significance;

6-10) coordination of the placement of outdoor (visual) advertising facilities in the right-of-way of public roads of regional and district significance;

6-11) organization and development of roadside service facilities on highways of regional and district significance;

6-12) installation of automated measuring stations on public roads of regional and district significance, streets of settlements in coordination with the road authority;

6-13) ensuring the functioning of automated measuring stations on public roads of regional and district significance, streets of settlements in accordance with the procedure established by the rules for organizing the operation of automated measuring stations;

7) exercising other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan in the interests of local government.

The jurisdiction of local executive bodies of the city of republican significance and the capital also includes:

1) development and approval of the rules for the operation of toll streets (sections) of the city of republican significance, the capital;

2) making a decision on the use of streets (sections) of the city of republican significance, the capital on a paid basis;

3) development and approval of the rules for charging fees and rates for travel on toll streets of the city of republican significance, the capital, as the toll is introduced.

2. The jurisdiction of district (cities of regional significance) executive bodies in the field of highways and road activities includes:

1) excluded by the Law of the Republic of Kazakhstan dated 07/03/2013 No. 124-V (effective after ten calendar days after its first official publication);

2) organization of works on construction, reconstruction, repair and maintenance of public roads of regional significance, streets of settlements in accordance with the legislation of the Republic of Kazakhstan on public procurement, in the field of public-private partnership and on concessions;

2-1) development of proposals for the transfer of sections of highways (bridge crossings) for the implementation of a public-private partnership project, including a concession, the order and conditions of their operation, and the amount of fares for them;

2-2) construction, reconstruction, repair and maintenance of access roads of regional importance to tourist facilities located outside settlements;

3) management of the network of public roads of regional importance, streets of settlements;

4) management of roads and road enterprises owned by municipal districts (cities of regional significance);

5) (excluded);

6) implementation of state control during the construction, reconstruction, repair and maintenance of public roads of regional significance, streets in cities of regional significance and other settlements within the districts;

7) making a decision on the provision of highways of regional significance or their sections for gratuitous temporary use;

8) exercising other powers assigned to local executive bodies by the legislation of the Republic of Kazakhstan in the interests of local government.

The Law of the Republic of Kazakhstan dated July 17, 2001 No. 245.

This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
