Article 13. Competence of the Government of the Republic of Kazakhstan in the field of the use of airspace and aviation activities The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

Government of the Republic of Kazakhstan:

1) develops the main directions of state policy in the field of the use of airspace and aviation activities;

2) carries out international cooperation in the field of the use of airspace;

3) determines the authorized bodies in the fields of civil and state aviation;

3-1) approves the flight safety program in the field of civil aviation;

3-2) approves the program of simplification of formalities in international air transportation, which is a set of measures designed to facilitate the establishment of procedures for simplification of formalities in civil aviation of the Republic of Kazakhstan;

4) approves the Rules for the use of the Airspace of the Republic of Kazakhstan;

5) excluded by the Law of the Republic of Kazakhstan dated 05/10/2017 No. 64-VI (effective ten calendar days after the date of its first official publication);

6) approves the Rules for the organization and provision of particularly important flights of the Republic of Kazakhstan;

44) approves the Aviation Safety Program of the Civil Aviation of the Republic of Kazakhstan;

54) approves Rules for subsidizing air routes;

55) approves the Aviation Safety Rules of the Republic of Kazakhstan;

56) approves the Rules for conducting quality control over compliance with Aviation safety;

57) excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

58) approves a special list of officials of the Republic of Kazakhstan transported by air transport, in respect of whom no inspection is carried out;

59) approves the list of persons serviced in specially designated halls of airports of the Republic of Kazakhstan;

60-2) determines priority international air routes to be subsidized in accordance with the procedure established by this Law.;

60-3) approves rules for subsidizing aviation fuel for priority international air routes;

61) performs other powers assigned to him by the Constitution, this Law, other laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
