1. Conformity assessment bodies are subject to accreditation in accordance with the procedure established by the legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment.

2. In case of mandatory confirmation, conformity assessment bodies must use the test results of accredited laboratories.

3. Conformity assessment bodies, under the terms of an agreement with applicants, perform the following functions within the scope of accreditation::

1) review applicants' applications for mandatory and voluntary conformity assessment, identify products and services provided for conformity assessment;

2) carry out work on mandatory and voluntary conformity assessment;

3) carry out, at the request of the applicants, the work necessary for the adoption of the declaration of conformity.

4. Conformity assessment bodies may:

1) to carry out mandatory and voluntary confirmation of conformity of technical regulation facilities within the scope of accreditation at the request of applicants with the issuance of certificates of conformity and (or) registration of declarations of conformity;

2) request from applicants the submission of documents and (or) information necessary for the performance of conformity assessment work.

5. The conformity assessment bodies are required to:

1) provide applicants with unhindered access to information on procedures and conditions for conformity assessment;

2) not to discriminate against applicants;

3) to record data on registered, issued, suspended, cancelled (terminated) conformity assessment documents, refusals of certification and their transfer in accordance with the rules of conformity assessment;

4) to ensure the confidentiality of information constituting the commercial interest of applicants, regardless of the country of origin of the products, services;

5) comply with the requirements of the legislation of the Republic of Kazakhstan in the field of technical regulation.

6. Conformity assessment bodies and expert auditors are responsible for violations of the legislation of the Republic of Kazakhstan in the field of technical regulation in accordance with the laws of the Republic of Kazakhstan.

7. Conformity assessment bodies are not authorized to provide consulting services in the field of accreditation and should not be affiliated with the persons providing these services.

8. Conformity assessment bodies must have ownership or other legal basis and use laboratories that provide testing of technical regulation facilities.

This Law establishes the fundamental principles of technical regulation that arise when establishing and fulfilling requirements for products, related processes, and the provision of services, and also defines the legal basis for the functioning of the state system of technical regulation.
