1. The organization of mediators is a self-regulating organization established by mediators on a voluntary basis in order to ensure the material, organizational, legal and other conditions for the provision of mediation services by mediators.

2. Excluded by the Law of the Republic of Kazakhstan dated 20.12.021 No. 84-VII (effective ten calendar days after the date of its first official publication).

3. The organization of mediators performs the following functions:

1) maintains a register of professional mediators – members of the organization of mediators;

2) develops and approves the terms of membership of mediators engaged in professional activities;

3) organizes information and methodological support for members of the organization of mediators in the field of mediation activities;

4) represents the interests of the members of the organization of mediators in their relations with government agencies, as well as with international organizations of mediators;

5) ensures that members of the mediation organization comply with the requirements of this Law and other regulatory legal acts of the Republic of Kazakhstan;

6) establishes and applies measures of influence against members of the mediation organization;

7) organizes professional training and advanced training of mediators with the issuance of a document (certificate) confirming the completion of training in the mediation training program.

4. In order to coordinate their activities, develop and unify standards (rules) for the professional activity of mediators, the procedure (regulations) for conducting mediation, and the procedure for payment of remuneration by the mediation parties to mediators, organizations of mediators may form an association (union).

5. Joining an organization of mediators or an association (union) of mediators is carried out on a voluntary basis. At the same time, the collection of entrance fees by the organization of mediators or the association (union) of mediators is not allowed.

6. The Association (union) of mediators has the right to develop and approve a Code of Professional Ethics for Mediators.

The Law of the Republic of Kazakhstan dated January 28, 2011 No. 401-IV.

This Law regulates public relations in the field of mediation in the Republic of Kazakhstan, defines its principles and procedure, as well as the status of the mediator.
