Article 13. Personnel of subjects of foreign intelligence of the Law On Foreign Intelligence

Article 13. Personnel of subjects of foreign intelligence of the Law On Foreign Intelligence

     1. The staff of the foreign intelligence agency consists of employees and employees.

     2. The employees of the foreign intelligence agency are representatives of the State authorities and are protected by the State.

     3. Employees and military personnel of foreign intelligence entities who were arrested or taken hostage while performing their duties outside the Republic of Kazakhstan, as well as interned in neutral countries, retain the status of employees and military personnel. The heads of foreign intelligence agencies and other authorized government agencies are required to take measures to protect the rights of these employees and military personnel in accordance with international law.

     4. In order to achieve the goals of intelligence activities, employees and military personnel of foreign intelligence entities may hold positions and be seconded to state bodies and organizations, regardless of their forms of ownership, without disclosing their departmental affiliation and with remaining in military service or service in special state bodies.

     Officials of these bodies and organizations are responsible, as provided for by the laws of the Republic of Kazakhstan, for disclosing information about the affiliation of employees and military personnel to foreign intelligence entities that has become known to them.

     5. Employees and military personnel of foreign intelligence entities are in the personnel, active reserve and reserve. Employees and military personnel of foreign intelligence entities have the right to carry and store weapons and special equipment in accordance with the laws of the Republic of Kazakhstan.

     The head of the foreign intelligence agency counts certain categories of employees in the length of service of their work experience before enlisting in the service of the foreign intelligence agency.

     The time spent by employees of the foreign intelligence agency on assignments in the special services of foreign states and other foreign organizations, criminal groups is subject to offset in terms of length of service in preferential terms for the appointment of pension payments, the assignment of a special rank and the calculation of official salary in accordance with the procedure determined by the Government of the Republic of Kazakhstan.

 

 

The Law of the Republic of Kazakhstan dated May 22, 2010 No. 277-IV.

     This Law defines the status, competence and organization of activities of foreign intelligence entities of the Republic of Kazakhstan and members of the intelligence community of the Republic of Kazakhstan.
