Article 13. The main provisions and principles of operation of the public-private partnership facility The Law on Public-Private Partnership
1. Subjects of public-private partnership are obliged to comply with the following principles of operation of the public-private partnership facility to the extent that does not contradict the public-private partnership project:
1) adjustment of the parameters of the provision of goods, works and services in order to meet the demand for these goods, works and services;
2) ensuring the continuity of the provision of goods, works and services.
2. The private partner, in agreement with the public partner, establishes the procedure for the operation of the public-private partnership facility and ensures its compliance. If the operator carries out the operation of the public-private partnership facility, the operation procedure is determined by the public-private partnership agreement and the operation agreement, if any.
3. A private partner may not give preference to one person over another in relation to the provision of services, except in cases provided for by the legislation of the Republic of Kazakhstan.
4. The period of operation of the public-private partnership facility is set for a period of at least five years, depending on the specifics of the public-private partnership project.

This Law defines the legal conditions of a public-private partnership, its methods of implementation and regulates public relations arising in the process of preparing and implementing a public-private partnership project, concluding, executing and terminating a public-private partnership agreement.
