Article 13. The specifics of advertising certain types of products (works and services) The Law on Advertising

Article 13. The specifics of advertising certain types of products (works and services) The Law on Advertising  

      1. Advertising is prohibited:

     1) ethyl alcohol and alcoholic beverages, products imitating alcoholic beverages;

     2) breast milk substitutes;

     3) goods (works, services) subject to mandatory conformity assessment that have not passed their conformity assessment;

     4) tobacco and tobacco products, including non-smoking tobacco products, products with heated tobacco, hookah tobacco, hookah mixture, tobacco heating systems, electronic consumption systems (vapes) and liquids for them, products imitating tobacco products;

     5) in the form of various events, including prize draws, lotteries, aimed at stimulating demand and interest in alcoholic beverages, tobacco and tobacco products, including non-smoking tobacco products, products with heated tobacco, hookah tobacco, hookah mixture, tobacco heating systems, electronic consumption systems (vapes) and liquids for them;

     5-1) in the form of demonstrations of tobacco products and the process of tobacco consumption in audiovisual works intended for children, including television and video films, in theatrical and entertainment performances, in radio, television, video and newsreel programs, as well as public performance, broadcast, cable and any other use of these works, presentations, programs in which tobacco products and the process of tobacco consumption are demonstrated;

     5-2) in the form of demonstrations of tobacco products and the process of tobacco consumption in audiovisual works intended for adults, including television and video films, in theatrical and entertainment performances, in radio, television, video and newsreel programs, as well as public performance, broadcast, cable and any other use of these works, performances, programs in which tobacco products and the process of tobacco consumption are demonstrated, except in cases where such an action is an integral part of the artistic idea.;

     6) the activities of the financial (investment) pyramid.

     1-1. It is prohibited to advertise goods (works, services) using trademark elements and (or) the name known as the name of alcoholic beverages, products imitating alcoholic beverages, tobacco and tobacco products, including non-smoking tobacco products, products with heated tobacco, hookah tobacco, hookah mixture, tobacco heating systems, electronic consumption systems (vapes) and liquids for them, which directly or indirectly offer alcoholic products, products imitating alcoholic beverages, tobacco and tobacco products, including non-smoking tobacco products, electronic consumption systems (vapes) and liquids for them, with the exception of advertising a trademark and (or) the name of a wine produced in the territory of the Republic of Kazakhstan that meets the requirements of Article 14-2 of this Law.

     1-2. It is prohibited to advertise services for mandatory conformity assessment and (or) intermediary services in the field of product conformity assessment by organizations that are not accredited in accordance with the procedure established by the legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment.

     1-3. Lottery advertising is prohibited, with the exception of advertising placed by the lottery operator and (or) lottery distributors (agents) within the framework of an assignment agreement concluded with the lottery operator.

     1-4. Advertising of betting shops and/or sweepstakes is prohibited.:

     1) external (visual), except for those located within the territories established by Article 11 of the Law of the Republic of Kazakhstan "On Gambling;

     1-1) in buildings and structures, with the exception of those located inside sports facilities during sporting events;

     2) on vehicles;

     3) in mass media, on online platforms, in film, video and reference services, with the exception of advertising on the official Internet resources of betting shops and sweepstakes licensed to engage in gambling business in the Republic of Kazakhstan, in mass media registered with the authorized body in the field mass media with an exclusively sports-themed focus, as well as during the live broadcast of international sports competitions by domestic TV channels;

     4) by transmitting it to cellular subscriber devices.

     1-5. Advertising of betting shops and (or) sweepstakes may contain only the name, trademark elements, location, Internet resource (if any) of the betting shop and (or) the sweepstake, the date of issue, validity period and license number for the activities of the betting shop and (or) the sweepstake.

     3. The specifics of advertising medical services, methods and means of prevention, diagnosis, treatment and medical rehabilitation, medicines and medical products controlled by the state sanitary and epidemiological control and supervision of products (goods) subject to state registration are regulated by the legislation of the Republic of Kazakhstan in the field of healthcare.

     4. Excluded by the Law of the Republic of Kazakhstan dated 07/16/2009 No. 186-IV.

     5. Advertising of service and civilian weapons, as well as weapons, military equipment and dual-use products, the export and import of which are carried out in accordance with the legislation of the Republic of Kazakhstan, is allowed only in special publications, as well as at specialized exhibitions or sales fairs. The specified advertisement should not directly or indirectly disclose the production technology, methods of use of military and special weapons, weapons, military equipment.

     5-1. When demonstrating audiovisual works, including television and video films, television, video and newsreel programs in which tobacco products and the process of tobacco consumption are demonstrated, the broadcaster or the organizer of the demonstration must provide an accompanying text message about the dangers of tobacco use immediately before or during the demonstration of such a work, program.

     6. Advertising of an commissioned residential building (residential building) that does not comply with the classification of residential buildings (residential buildings) in the approved construction project is prohibited.

 

The Law of the Republic of Kazakhstan dated December 19, 2003 No. 508.

     This Law regulates the relations arising in the process of production, distribution, placement and use of advertising in the territory of the Republic of Kazakhstan.
