Article 14. Appraiser's rights The Law on Valuation Activities in the Republic of Kazakhstan
1. The appraiser has the right to:
1) independently apply assessment methods and approaches to assessment in accordance with assessment standards and (or) international assessment standards, indicating the source;
2) require the customer to provide access to the evaluation object, as well as to the documentation in full, necessary for the evaluation.;
3) to receive explanations from the customer, as well as additional information necessary for the assessment;
4) involve, as necessary, on a contractual basis, a specialist (specialists) to participate in the assessment;
5) to refuse to conduct an assessment in cases where the customer has violated the terms of the evaluation agreement and has not provided the necessary information about the evaluation object.;
6) request in writing or orally from third parties information necessary for conducting an assessment, with the exception of information constituting state secrets, commercial and other legally protected secrets.
2. In case of refusal to provide the information specified in subitems 2), 3) and 6) of paragraph 1 of this article, which significantly affects the reliability of the assessment results, the appraiser shall indicate this in the assessment report.
3. Within three months from the date of the Chamber of Appraisers' exclusion from the register of self-regulating organizations of appraisers, appraisers who are its members and have not joined other chambers of appraisers are entitled to carry out appraisal activities only under contracts concluded before the date of the Chamber of Appraisers' exclusion from the register of self-regulating organizations of appraisers.
4. Provisions of the sub-paragraphs 2), 3), 4), 5) and 6) of paragraphs 1 and 3 of this article apply to the legal entity with which the appraiser has concluded an employment contract.
This Law regulates public relations related to the implementation of valuation activities in the Republic of Kazakhstan, and also defines the legal basis for regulating valuation activities.
