Article 14. Competence of the authorized body in the field of civil aviation in the field of the use of airspace and aviation activities The Law on the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities

1. The authorized body in the field of civil aviation within its competence:

1) carries out state regulation, state control and supervision over compliance by individuals and legal entities with the legislation of the Republic of Kazakhstan on the use of the airspace of the Republic of Kazakhstan and aviation activities and (or) international standards;

1-1) decides on the admission of airports to provide international flights of aircraft;

1-2) Approves the list of dangerous substances and objects, as well as all types of drugs prohibited for passengers to be transported on civil aircraft;

2) implements the main directions of state policy in the field of the use of airspace and the activities of civil and experimental aviation;

2-1) Is excluded by the Law of the Republic of Kazakhstan dated December 29, 2022 No. 174-VII (effective sixty calendar days after the date of its first official publication). 2-2) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective from 08/01/2019); 2-3) excluded by the Law of the Republic of Kazakhstan dated 04/19/2019 No. 249-VI (effective from 08/01/2019);

4) approves the Rules of flight operations in the civil aviation of the Republic of Kazakhstan;

5) approves the Instructions for the organization and maintenance of air traffic;

5-1) takes measures to stop violations of the procedure for the use of airspace by civil aircraft in cooperation with the authorized body in the field of state aviation, special state and law enforcement agencies;

5-2) keeps records of violations of the rules for the use of airspace by civil and experimental aviation, and also carries out the mutual exchange of information on all cases of violations of the rules for the use of airspace with the authorized body in the field of state aviation;

10) carries out international cooperation with aviation authorities of foreign states and specialized international organizations, including through the conclusion of bilateral agreements on cooperation, exchange of experience and information related to civil aviation, as well as representation of the Republic of Kazakhstan in international civil aviation organizations;

11) participates in the conclusion of international treaties of the Republic of Kazakhstan in the field of civil aviation;

12) approves the Rules for Issuing and grounds for refusing to issue permits for International irregular flights;

13) approves the Rules for decommissioning aircraft;

13-1) approves the rules for limiting foreign participation (control) in an airline established in the form of a joint-stock company;

14) approves standard instructions for flight safety management for civil aircraft operators, airports, air traffic services, aircraft maintenance, and aviation training centers for civil aviation, whose activities are related to aircraft operations during the provision of services;

15) approves standard training programs for aviation personnel involved in flight safety;

15-1) approves the rules of testing to determine the level of proficiency in English used in radiotelephony communication;

23) approves the schedule of regular flights of foreign air carriers, as well as Instructions for approving the schedule of regular flights of foreign air carriers on international air routes of the Republic of Kazakhstan;

24) approves the Instructions for calculating the cost of a flight hour when flying on subsidized routes;

41-1) in coordination with the authorized body in the field of state aviation, determines the procedure for the use of airspace over the capital and the capital airport in accordance with the Rules for the Use of the Airspace of the Republic of Kazakhstan.;

41-4) organizes work on the investigation of aviation accidents and civil aviation incidents in the territory of the Republic of Kazakhstan;

41-5) participates in the investigation of aviation accidents and civil aviation incidents on the territory of other states that have occurred with aircraft that are registered in the State Register of Civil Aircraft of the Republic of Kazakhstan or aircraft operators are individuals or legal entities of the Republic of Kazakhstan;

41-6) issues recommendations in order to prevent aviation accidents and incidents or reduce their consequences, as well as analyzes the implementation of such recommendations;

41-7) maintains statistical data on aviation accidents and incidents involving aircraft registered in the State Register of Civil Aircraft of the Republic of Kazakhstan or operated by individuals or legal entities of the Republic of Kazakhstan;

41-8) maintains statistical data on aviation accidents and incidents involving aircraft operated by foreign countries on the territory of the Republic of Kazakhstan;

41-9) participates in the exchange of statistical data with international civil aviation organizations;

41-10) cooperates with the authorities of foreign States and international civil aviation organizations responsible for the investigation of aviation accidents and incidents;

41-11) cooperates with interested government agencies of the Republic of Kazakhstan on the investigation of aviation accidents and incidents;

41-12) ensures the safety of evidence during the investigation of aviation accidents and incidents;

41-13) ensures the protection of confidential flight safety information;

41-14) develops, implements, studies and maintains a system for mandatory and voluntary reporting of aviation event data, including a mechanism for collecting, evaluating, processing, storing and recording aviation events;

41-15) participates in the exchange of information on flight safety at the national and international levels and in the dissemination of information on aviation events;

41-16) collects and analyzes information related to the safety of civil aviation flights, as well as compiles and communicates such information to individuals and legal entities engaged in activities in the field of civil aviation. The analysis does not require disclosure of information sources;

41-17) approves the rules of flight radio engineering and aviation telecommunications in civil aviation;

41-18) approves the rules for providing aeronautical information in civil aviation;

41-19) approves the airworthiness standards of civil aircraft of the Republic of Kazakhstan;

41-20) approves the rules for certification and type certificate issuance;

41-21) is excluded by the Law of the Republic of Kazakhstan dated 05/10/2017 No. 64-VI (effective ten calendar days after the date of its first official publication);

41-22) approves the rules for certification and issuance of a certificate of airworthiness of a civil aircraft of the Republic of Kazakhstan;

41-23) approves the rules of certification in the field of light and ultralight aircraft;

41-24) approves the rules of technical operation and repair of civil aircraft of the Republic of Kazakhstan;

41-25) approves the rules for certification and issuance of a certificate of an organization for maintenance and repair of civil aviation equipment;

41-26) approves the rules for certification and issuance of the certificate of the Aviation Training Center for Civil Aviation;

41-27) approves the rules for certification and issuance of an air navigation service provider certificate, as well as certification requirements for air navigation service providers;

41-28) approves the rules of professional training of aviation personnel;

41-29) is excluded by the Law of the Republic of Kazakhstan dated 05/10/2017 No. 64-VI (effective ten calendar days after the date of its first official publication);

41-30) approves the rules for the organization of working hours and rest for crew members of civil and experimental aviation aircraft of the Republic of Kazakhstan;

41-31) approves the rules for certification and issuance of an operator's certificate for civil aircraft;

41-32) approves the rules for the operator's admission to aviation operations;

41-33) approves the rules for the admission of general aviation operators to flights;

41-35) approves the model regulations on flying clubs;

41-36) approves the rules for the organization of flight operations in civil aviation of the Republic of Kazakhstan;

41-38) approves the rules for certification and issuance of the certificate of airworthiness of the airfield (heliport);

41-39) approves the standards of serviceability of civil aviation airfields (heliports);

41-40) approves the methodology for assessing compliance with the standards of serviceability of civil aviation airfields (heliports);

41-41) approves the rules of airfield maintenance in civil aviation;

41-42) approves the rules of electric lighting support for civil aviation flights of the Republic of Kazakhstan;

41-43) approves the rules for the organization of special transport operations at airports of the Republic of Kazakhstan;

41-44) approves the rules for providing aviation fuels and lubricants to civil aircraft;

41-45) approves the rules for storage, preparation for refueling and quality control of aviation fuels and lubricants and special liquids in civil aviation organizations of the Republic of Kazakhstan;

41-46) Approves the rules for managing hazards caused by birds and other animals for flights of civil aircraft in the Republic of Kazakhstan;

41-47) approves the rules for the organization of passenger services at airports of the Republic of Kazakhstan;

41-48) approves the rules of fire safety in civil aviation of the Republic of Kazakhstan;

41-49) approves the rules of emergency flight support at airports of the Republic of Kazakhstan;

41-50) approves the standard regulation on the air transportation service;

41-51) approves the model regulation on the Aviation Security Service;

41-52) approves the standard regulation on the production and dispatch service of civil aviation organizations;

41-53) approves the rules for certification and issuance of the certificate of the airport (airfield) aviation security service, as well as the certification requirements for the airport (airfield) aviation security service;

41-54) approves the rules for pre-flight and special inspections of aircraft;

41-55) approves the lists of positions of heads and specialists of aviation security services of civil aviation organizations of the Republic of Kazakhstan, as well as qualification requirements for such positions;

41-56) approves certification requirements for civil aircraft operators;

41-57) approves certification requirements for aviation training centers;

41-58) approves certification requirements for organizations engaged in maintenance and repair of aviation equipment;

41-59) approves requirements for organizations providing fuel and lubricants to civil aircraft;

41-61) approves the rules for the admission of airlines to perform scheduled domestic commercial air transportation;

41-63) approves the electronic air waybill form;

41-64) approves the rules of information interaction in the transportation and handling of baggage, mail and cargo by air;

41-73) develops and approves rules for access to the provision of services on the territory of the airport (airfield) that are not related to airport activities;

41-74) approves the procedure for subsidizing airports owned by municipalities that do not provide sufficient income to cover operating costs with passenger traffic of less than two hundred thousand passengers per year, in coordination with the central authorized body for state planning and the central authorized body for budget planning.;

41-75) approves the rules for anti-icing protection of aircraft on the ground;

41-76) Approves the rules for collecting payments in the field of civil aviation;

41-77) approves the list of paid services of an authorized organization in the field of civil aviation and the rates of payments in the field of civil aviation;

41-78) approves the methodology for calculating infrastructure fees in coordination with the antimonopoly authority.;

42) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

4. The department of the authorized body in the field of civil aviation, within the limits of its competence, has the right to apply the measures provided for in subparagraphs 1), 2) and 4) of paragraph 2 of Article 16-6 of this Law.

This Law regulates public relations related to the use of the airspace of the Republic of Kazakhstan and aviation activities, and defines the procedure for the use of airspace and aviation activities in order to protect human life and health, the environment, the interests of the state, ensure the safety of aircraft flights and meet the needs of the economy of the Republic of Kazakhstan, individuals and legal entities in aviation services.
