Article 14. Inadmissibility of joint service (work)close relatives, spouses, or relatives The Anti-Corruption Law
1. Persons holding responsible government positions, persons authorized to perform government functions (with the exception of deputies of maslikhats who do not carry out their activities on a permanent or vacated basis), and persons equated to persons authorized to perform government functions (with the exception of candidates for President of the Republic of Kazakhstan, deputies of the Parliament of the Republic of Kazakhstan or maslikhats, akims districts, cities of regional significance, cities of district significance, towns, villages, rural districts, as well as members of elected local government bodies), Officials may not hold positions that are directly subordinate to positions held by their close relatives, spouse and/or relatives, or have close relatives, spouse and/or relatives directly subordinate to them.
1-1. Persons who are candidates for a government position or a position related to the performance of government or equivalent functions are required to notify the management of the organization for which they are applying in writing about their close relatives, spouse and (or) relatives working in this organization.
2. Persons who violate the requirements of paragraph 1 of this article, if they do not voluntarily eliminate it within three months of the discovery of the said violation, shall be transferred to positions excluding such subordination, and if such transfer is not possible, one of these employees shall be dismissed from office or otherwise relieved of these functions.
3. The persons referred to in paragraph 1 of this Article are prohibited from holding positions with their close relatives, spouse and/or relatives in the same governing body (supervisory board, executive body) of a quasi-public sector entity.
Persons who violate the requirements of part one of this paragraph, if they do not voluntarily eliminate it within three months of the discovery of the said violation, are subject to transfer to positions that exclude joint service (work) in one management body (supervisory board, executive body) of a quasi-public sector entity, and if such transfer is not possible, one of these employees is subject to dismissal from office or other dismissal from these functions.
Note. In this Law, close relatives are understood to mean parents (parent), children, adoptive parents (adoptive parents), adopted children, full– and half-siblings, grandparents, grandchildren, and relatives - full- and half-siblings, parents and children of a spouse.
