Article 14. Income of the Commodity Exchange of the Commodity Exchange Act

Article 14. Income of the Commodity Exchange of the Commodity Exchange Act

      1. The income of the commodity exchange is generated by the entrance and annual fees of the members of the commodity exchange, payments for the use of the exchange's property, registration and execution of exchange transactions, and other income not prohibited by law.  

      2. The Commodity Exchange has the right to establish:  

      1) the amount and procedure of contributions by the members of the commodity exchange;  

      2) the amount of payments for participation in the auction in accordance with the rules of exchange trading;  

      2-1) differentiated exchange fee depending on the volume of transactions made by the members of the commodity exchange.  - Excluded by the Law of the Republic of Kazakhstan.

     For dealers who have an industrial certificate and carry out activities on the commodity exchange for the sale of goods produced by them, a differentiated fee is established taking into account the increase in the domestic value of the goods purchased by subsurface users and taking into account the international obligations of the Republic of Kazakhstan.;

      3) the minimum and maximum limits of the price levels for a specific exchange-traded commodity within one trading day based on the prices formed as a result of previous trades, in order to suspend trading in order to prevent speculative actions.  

      3. The commodity exchange is prohibited from setting the amount of remuneration charged by brokers for mediation in exchange transactions.  

     4. The amounts of payments charged from participants in exchange trading are determined by the internal documents of the commodity exchange and should be available for review by participants in exchange trading.

 

 

The Law of the Republic of Kazakhstan dated May 4, 2009 No. 155-IV.

      This Law regulates public relations arising in the course of commodity exchanges and exchange trading, establishes the procedure for regulating and state control over the activities of commodity exchanges in order to ensure their open and effective functioning, protect the rights of participants in exchange trading and fair competition between them.
