Article 14. Information in the field of intelligence, counterintelligence, operational-investigative and other activities classified as state secrets of the Republic of Kazakhstan by the Law on State Secrets
State secrets in the field of intelligence, counterintelligence, operational-investigative and other activities include:
1) information revealing the forces, means, sources, methods, plans, condition, organization, results of intelligence, counterintelligence, operational-investigative activities that were not used in the criminal process as factual data relevant to the proper resolution of the criminal case, as well as data on the financing of intelligence, counterintelligence, operational-investigative activities, if they disclose the listed information;
1-1) information disclosing the forces, means, forms, methods and results of activities to ensure the safety of persons in respect of whom a decision has been made to apply personal security measures to participants in criminal proceedings, data on the financing of this activity, if they disclose the listed information, as well as information about persons in respect of whom security measures have been applied, provided for by subitems 6) and 7) of the first part of paragraph 2 of Article 7 of the Law of the Republic of Kazakhstan "On State Protection of persons participating in criminal proceedings";
2) information revealing the affiliation of specific persons to the personnel of the intelligence and counterintelligence agencies of the Republic of Kazakhstan;
3) information about persons providing confidential assistance to the bodies of the Republic of Kazakhstan engaged in intelligence activities;
4) information revealing the status and results of operational mobilization work carried out in the field of foreign intelligence;
5) information about persons who cooperate (have cooperated) on a confidential basis with the authorities of the Republic of Kazakhstan engaged in counterintelligence or operational search activities;
6) information revealing the status, results, as well as measures of operational mobilization work;
7) information disclosing the forces, means, methods, plans, status and results of the activities of electronic intelligence agencies, communications facilities, as well as data on the financing of these activities, if these data disclose the listed information;
8) information disclosing the forces, means, methods, plans or results of intelligence, counterintelligence, operational search activities of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, as well as data on the financing of these activities, if these data disclose the listed information;
9) information about persons who cooperate (have cooperated) on a confidential basis with units of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan engaged in intelligence, counterintelligence or operational search activities;
10) information about the government communications system, encrypted, classified, encoded or other types of special communications and information about government ciphers, codes, methods or means of their analysis, means of encryption, classification, encoding;
11) information on the organization, forces, means and methods of ensuring the security of the President of the Republic of Kazakhstan and his family members, on the state of health and personal life of the President of the Republic of Kazakhstan, ex-Presidents of the Republic of Kazakhstan and their family members;
12) information revealing the organization, forces, means or methods of ensuring the safety of other protected persons of the highest authorities and management;
13) information revealing the forces, means and methods of units for combating organized crime, as well as their operational search and operational technical measures;
14) information revealing the affiliation of specific individuals to the personnel of the penal enforcement system, operational units of the economic investigation service and the anti-corruption service, as well as internal affairs bodies;
15) information revealing the forces, means and methods of conducting investigations in criminal cases affecting the interests of the security of the Republic of Kazakhstan;
16) information revealing the organization or the actual state of protection of state secrets;
17) information disclosing planned and (or) ongoing measures to protect information from unauthorized access, foreign technical intelligence and leakage through technical channels;
18) information about employees of special forces units, persons participating and (or) assisting in conducting an anti-terrorist operation, detecting, preventing, suppressing and uncovering an act of terrorism, and family members of these persons;
18-1) information revealing the tactics, form, methods, means and composition of participants in anti-terrorist operations;
19) information about electronic information resources containing information constituting state secrets and information systems in a protected version classified as state secrets.
The Law of the Republic of Kazakhstan dated March 15, 1999 N 349-1.
This Law defines the legal framework and a unified system for the protection of state secrets in the interests of ensuring the national security of the Republic of Kazakhstan, regulates public relations arising in connection with the classification of information as state secrets, their classification, disposal, protection and declassification.
