Article 15-4. Safety requirements for the operation of inland waterway vessels, ports, coastal facilities and structures on inland waterways of the Law on Inland Waterway Transport

     1. Inland waterway vessels, ports, coastal facilities and structures on inland waterways related to the navigation process are high-risk zones and must comply with the requirements of the legislation of the Republic of Kazakhstan on inland waterway transport.

     2. Excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).  

     3. Small-deck vessels subject to state registration in the ship's register must comply with the requirements of the rules for the technical supervision of small-deck vessels.

     4. Excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication).  

     5. The use of vessels subject to state registration in the ship's register and bases (facilities) for their parking is carried out in accordance with the Rules for the Use of Small vessels and bases (facilities) for their parking.

     6. Boatmasters of self-propelled vessels subject to state registration in the ship's register must complete training in the boatmaster training program and carry with them a certificate for the right to operate a self-propelled small vessel.

     The issuance of a certificate for the right to operate a small vessel, the coordination of the training program for boatmasters and the accounting of training courses for boatmasters of small vessels are carried out by local executive bodies in accordance with the Rules for certification of boatmasters for the right to operate a small vessel.

     When opening courses for the training of boatmasters of small vessels, organizations send a notification to the local executive body about the start of activities with an attachment.:

      1) copies of diplomas of higher or secondary technical education in the specialty of water transport for teaching staff;  

     2) the training program for the training of boatmasters of small vessels, developed on the basis of the standard training program for boatmasters of small vessels, in accordance with the rules of certification of boatmasters for the right to operate a small vessel;

     3) copies of the document confirming the existence of the premises owned or leased for the organization of the educational process.

     Notification of the beginning or termination of activities for the training of small-size vessel skippers is submitted in accordance with the procedure established by the Law of the Republic of Kazakhstan "On Permits and Notifications".

     Organizations that have opened training courses for boatmasters of small vessels are required to send to the local executive body lists of persons who have successfully completed training under the training program for boatmasters of small vessels. The procedure for providing information about persons who have completed training is determined by the Rules of Certification of boatmasters for the right to operate a small vessel.

 

 

The Law of the Republic of Kazakhstan dated July 6, 2004 No. 574.

     This Law regulates public relations that arise between government agencies, individuals and legal entities in the field of inland waterway transport during navigation, transportation of passengers, baggage and cargo, operation of small vessels, including on bodies of water not related to inland waterways and sea waters, and also defines their rights, duties and responsibilities..
