Article 15. Compensation in case of injury or death (death) of a judge of the Constitutional Court of the Constitutional Law On the Constitutional Court of the Republic of Kazakhstan

     1. If a judge of the Constitutional Court receives an injury (injury, injury, contusion, occupational disease) during the performance of his official duties, he shall be paid a one-time compensation in the amount established by this article.

     2. In the event of the death (death) of a judge of the Constitutional Court in the performance of official duties or within a year after the termination of the powers of a judge of the Constitutional Court as a result of injury (injury, injury, contusion, occupational disease) sustained in the performance of official duties, the heirs are paid a one-time compensation in the amount of thirty months of the official salary of a judge of the Constitutional Court.

     In this case, a judge of the Constitutional Court shall be deprived of the right to compensation specified in part one of this paragraph if his powers are terminated due to the entry into force of the court's verdict of conviction against him.

     3. If a judge of the Constitutional Court is found to be disabled as a result of an injury (injury, injury, contusion, occupational disease) sustained in the performance of his official duties, he is paid a one-time compensation in the amount of:

     1) a person with a disability of the first group – a twenty-month salary;

     2) a person with a disability of the second group – a fifteen-month salary;

     3) a person with a disability of the third group – a five-month salary.

     4. If a judge of the Constitutional Court receives a serious injury (injury, injury, contusion, occupational disease) in the performance of his official duties, which did not result in disability, he is paid a one–time compensation in the amount of one and a half months official salary, and a minor injury - half a month official salary.

     5. For the burial of deceased or deceased judges of the Constitutional Court and pensioners who retired from the position of a judge of the Constitutional Court, a one-time monetary compensation is paid in the amount of three months' salary of a judge of the Constitutional Court at the time of their death.

     6. The procedure for payment of lump-sum compensation is determined by the Government of the Republic of Kazakhstan.

     7. One-time compensation shall not be paid if, in accordance with the procedure established by the legislation of the Republic of Kazakhstan, it is proved that the injury (injury, injury, contusion, occupational disease) or death (death) of a judge of the Constitutional Court occurred due to circumstances unrelated to the performance of official duties.
