Article 15. Competence of expert auditors on conformity assessment, requirements for them and grounds for suspension, revocation (revocation) of certificates of expert auditors on conformity assessment The Law on Technical Regulation

1. Conformity assessment audit experts participate in the work on conformity assessment of certain types of products, processes and services as part of the conformity assessment body.

2. Individuals are certified by an authorized body and have the right to act as an expert auditor for conformity assessment as part of only one conformity assessment body.

3. Expert auditors on conformity assessment are not entitled to perform work on conformity assessment of specific products, processes and services if they represent the interests of the applicant or are in an employment or other contractual relationship with him.

4. The suspension of the validity of the certificate of the expert auditor for the confirmation of conformity is carried out by the department of the authorized body in the event that it is established that the work on the confirmation of conformity has been carried out on the basis of such a certificate of the expert auditor by another person.

5. Deprivation (review) the certification of an expert auditor for conformity assessment is carried out by a court decision on the claim of the department of the authorized body, its territorial subdivision, or the accreditation body in the following cases::

1) establishing the fact that the expert auditor provided false or intentionally distorted information in the documents that were the basis for issuing the certificate;

2) re-establishment of the fact of performance of conformity assessment work on the basis of such a certificate of an expert auditor by another person;

3) a three-time violation of the legislation of the Republic of Kazakhstan, which does not entail the imposition of an administrative penalty in the form of suspension of the certificate of an expert auditor for conformity assessment;

4) repeated violation of the legislation of the Republic of Kazakhstan, which has caused damage to the rights and legitimate interests of individuals and legal entities, the interests of the state and (or) entailing the imposition of an administrative penalty in the form of suspension of the certificate of an expert auditor for conformity assessment.

This Law establishes the fundamental principles of technical regulation that arise when establishing and fulfilling requirements for products, related processes, and the provision of services, and also defines the legal basis for the functioning of the state system of technical regulation.
