Article 15. Competence of the authorized body of the relevant industry The Law on State Property
Authorized body of the relevant industry:
1) implements the state policy on the management of state property in the relevant industry, develops and approves regulatory legal acts in the field of state property management in the relevant industry within its competence.;
2) determines the priority areas of activity and mandatory amounts of work (services) financed from the budget of republican state-owned enterprises and, in cases provided for by the laws of the Republic of Kazakhstan, municipal state-owned enterprises.;
3) determines the subject and objectives of the activities of the republican state institution;
3-1), within the limits of its powers, decides on the assignment of names, renaming, clarifying and changing the transcription of their names and assigning proper names of persons to state legal entities, legal entities with the participation of the state;
4) makes proposals to the authorized body for state property on determining the subject and purpose of the activities of the republican state enterprise, as well as on determining the type of republican state enterprise (on the right of economic management or a state-owned enterprise) engaged in such activities;
5) reviews, coordinates, in cases provided for by this Law, and approves development plans for republican state-owned enterprises and reports on their implementation.;
6) monitors the safety of the property of republican legal entities and the implementation of development plans by republican state-owned enterprises;
7) monitors and analyzes the implementation of development plans of national management holdings, national holdings and national companies and action plans of national management holdings, national holdings, national companies of which the state is a shareholder in the relevant industry;
8) monitors and analyzes the implementation of development plans for republican state-owned enterprises, state-controlled joint-stock companies and limited liability partnerships in the relevant industry;
9) gives consent to the authorized body for state property for the withdrawal or redistribution of property transferred to a republican legal entity or acquired by it as a result of its own economic activities;
10) manages republican legal entities;
11) approves the charter (regulations) of republican state institutions, amendments and additions to it;
12) approves the annual financial statements of the republican legal entity;
13) sets prices for goods (works, services) produced and sold by republican state-owned enterprises;
14) approves plans for financing republican state institutions from the republican budget;
15) gives consent to the establishment of branches and representative offices by republican state institutions;
16) in coordination with the authorized body for state property, reorganizes and liquidates the republican legal entity;
17) develops a draft decision of the Government of the Republic of Kazakhstan on the implementation of the priority right to acquire a strategic facility;
18) in cases where the rights of ownership and use of a state-owned block of shares (shares in the authorized capital) have been transferred to him, appoints his representative to the relevant board of directors (supervisory board) of joint-stock companies (limited liability partnerships) in which the state is the sole shareholder (participant)., and in other joint-stock companies and limited liability partnerships with the participation of the state, submits a candidate to the boards of directors or supervisory boards for approval by the general meeting of shareholders or participants of the limited liability partnership.;
19) ensures or takes the necessary measures to include a representative of the authorized body for state property in the board of directors of a state-owned joint-stock company or the supervisory board of a limited liability company with state participation;
20) prepares information, including a list by name of state-owned legal entities under its management and legal entities with state participation, in respect of which it exercises the rights of the state as a shareholder (participant) to participate in management, in order to reflect this information in the register of state property;
20-1) makes proposals to the authorized body for state property, upon approval, to the republican state enterprise for the alienation or other disposal of the property assigned to it (except for the sale of products produced by it), the establishment of branches (representative offices);
20-2) approves a decision on the transfer of republican state property, with the exception of shares of joint-stock companies and shares in limited liability companies in respect of which the Republic of Kazakhstan is a shareholder (participant), and strategic facilities owned by the Republic, to pay for shares of the joint-stock company or to the authorized capital of the limited liability company;
21) exercise other powers defined by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

This Law defines the legal regime of state property, the legal basis for the management of State property, including property assigned to State-owned legal entities, and state-owned shares and stakes in the authorized capital of legal entities, the legal grounds for the acquisition and termination of rights to state property, and is aimed at ensuring the effective exercise by the State of the rights of the owner and holder of other rights. on state property.
