1. The export price of a product is determined based on data on its sale during the investigation period.

2. In the absence of data on the export price of the goods that are the subject of dumped imports, or the investigating authority has reasonable doubts about the accuracy of information on the export price of this product due to the fact that the exporter and importer of the goods are related persons (including due to the connection of each of them with a third party), or the presence of restrictive business practices in the form of collusion regarding the export price of such a product, its export price can be calculated based on the price, according to which the imported goods are first resold to an independent buyer, or by any other method that may be determined by the investigating authority, if the imported goods are not resold to an independent buyer or are not resold in the form in which they were imported into the customs territory of the Eurasian Economic Union. At the same time, in order to compare the export price of the goods with its normal value, expenses (including customs duties and taxes) paid in the period between import and resale of the goods, as well as profits, are also taken into account.

This Law regulates public relations related to the application of special protective, anti-dumping and countervailing measures in relation to third countries in order to protect the economic interests of the Republic of Kazakhstan.
