Article 15. General provisions Chapter 4. Safety of navigation The Law on Inland Waterway Transport
1. The preparation of the vessel for navigation, which meets the requirements of the safety of navigation, is the responsibility of the owner of the vessel and (or) the shipowner.
The vessel is allowed to sail in cases where:
1) meets the safety requirements in the field of inland waterway transport, including environmental and fire safety, sanitary and epidemiological rules and regulations established by the legislation of the Republic of Kazakhstan;
2) the number of the ship's crew on the day of its sailing is not less than the established requirements for the minimum composition of the ship's crew.
2. The owner of the vessel and (or) the shipowner are obliged to:
1) ensure the safe operation of ships;
2) appoint a person responsible for the safe operation of ships;
3) constantly improve the skills of ship's crew members and other employees in accordance with the requirements of navigation safety;
4) to ensure the manning of ships and to maintain ships in a technically sound condition in accordance with the requirements of the safety of navigation established by this Law.
3. Excluded by the Law of the Republic of Kazakhstan dated December 28, 2010 No. 369-IV (effective after ten calendar days after its first official publication).
4. Enterprises of the authorized body for ensuring the safety of navigation are obliged to carry out:
1) maintenance of inland waterways and navigable hydraulic structures (locks) in accordance with the state assignment for the program for ensuring navigable waterways and maintenance of locks.
If the water level drops below the design level and the authorized body determines that further dredging operations involving subsidence of the riverbed are impractical, enterprises of the authorized body are relieved of the obligation to ensure guaranteed dimensions of the ship's course.;
2) the passage of ships, rafts and other floating objects through locks and channels, while these measures are carried out at the expense of the carrier.
4-1. It is prohibited for vessels, with the exception of vessels of enterprises of the authorized body, regardless of their affiliation and nationality, to navigate navigable waterways that are not equipped with navigation equipment (before and after the opening of navigation).
A one-time passage of vessels to the berth site is allowed along certain sections of inland waterways where navigation equipment has been removed due to the end of the navigation period, in agreement with the territorial subdivision and the enterprise of the authorized body.
5. Owners of hydraulic engineering and other structures located on inland waterways are required to promptly inform territorial divisions of situations that threaten the safety of navigation in order to take appropriate measures.
5-1. Owners of navigable hydraulic structures (locks) are required to comply with the Rules of Technical Operation, Inspection and repair of navigable hydraulic structures (locks).
The safety criteria for navigable hydraulic structures (locks) are determined in accordance with the procedure established by the Rules of Technical Operation, Inspection and Repair of Navigable Hydraulic Structures (locks).
5-2. It is mandatory for shipping locks to have irreducible supplies of materials and equipment necessary for urgent emergency recovery and emergency prevention at the locks.
The list of irreducible stocks of materials and equipment, the procedure for their use and storage for each shipping lock are determined by the authorized body.
6. Territorial divisions, for the purposes of navigation safety, have the right to inspect a marine vessel flying the State flag of the Republic of Kazakhstan or a vessel flying the flag of a foreign state when entering inland waterways on the same grounds as vessels sailing on inland waterways.
7. Individuals and legal entities engaged in the manufacture of shipbuilding products and ship repairs must have a document of conformity issued by the Register of Shipping.

This Law regulates public relations that arise between government agencies, individuals and legal entities in the field of inland waterway transport during navigation, transportation of passengers, baggage and cargo, operation of small vessels, including on bodies of water not related to inland waterways and sea waters, and also defines their rights, duties and responsibilities..
