1. A member of the Public Council may resign from its membership at his own request by submitting a written application.

2. A member of the Public Council may be prematurely excluded from its membership by a decision of the Public Council if he is unable to participate in its work for health reasons or on the following grounds:

1) in case of his death;

2) recognition by the court as missing;

3) declaration of the deceased by the court;

4) recognition by the court as legally incompetent or with limited legal capacity in accordance with the procedure established by the laws of the Republic of Kazakhstan;

5) failure to attend a meeting of the Public Council for disrespectful reasons more than three times during one year;

6) admission of a member of the Public Council, elected from the civil society, to the civil service;

7) in case of liquidation of a non-profit organization, from which a representative was elected to the Public Council;

8) in case of occurrence of the grounds provided for in paragraph 1 of Article 10 of this Law.

3. The Public Council shall decide on the inclusion of a new member to the Public Council in place of the one who has retired for the remainder of his term of office in accordance with the procedure specified in paragraphs 9 and 10 of Article 9 of this Law.

This Law defines the legal status, procedure for the formation and organization of activities of public councils aimed at implementing state policy on the formation of a state accountable to the population, ensuring the broad participation of non-profit organizations and citizens in decision-making by government agencies at all levels, as well as national management holdings, national holdings, national companies (hereinafter referred to as quasi-public sector entities).
