Article 15. The right to purchase weapons by citizens of the Republic of Kazakhstan of the Law on State Control over the Turnover of Certain Types of Weapons
1. Citizens of the Republic of Kazakhstan who have reached the age of eighteen have the right to purchase civilian weapons, with the exception of firearms, smoothbore long-barreled self-defense weapons and hunting weapons, after obtaining permission to purchase a specific type of weapon from the internal affairs bodies at their place of residence.
Citizens of the Republic of Kazakhstan who have reached the age of 16 have the right to purchase, store, carry and use throwing weapons (bows and crossbows) for sporting purposes.
Mechanical sprayers, aerosol cans and other devices loaded with tear or irritating substances, pneumatic weapons with a muzzle energy of no more than 7.5 joules and a caliber up to 4.5 millimeters inclusive are not subject to registration.
Citizens of the Republic of Kazakhstan have the right to purchase signaling, chilled weapons, mechanical sprayers, aerosol and other devices equipped with tear or irritating substances, pneumatic weapons with a muzzle energy of no more than 7.5 joules and a caliber of up to 4.5 millimeters inclusive from legal entities – suppliers without obtaining permission.
Smoothbore long-barreled firearms specified in subparagraph 1) of Article 5 of this Law, citizens of the Republic of Kazakhstan who have reached the age of twenty-one have the right to acquire for self-defense purposes without the right to carry permits issued by internal affairs bodies at their place of residence, without a hunter's certificate.
Smoothbore long-barreled firearms and hunting pneumatic weapons may be purchased by citizens of the Republic of Kazakhstan who have reached the age of twenty-one with the right to keep and carry, who have hunter's certificates.
Citizens of the Republic of Kazakhstan who have owned smoothbore long-barreled hunting firearms for at least three years and who have been granted the right to hunt in accordance with the established procedure have the right to purchase hunting firearms with a rifled barrel.
The total number of weapons purchased by a citizen of the Republic of Kazakhstan should not exceed:
1) hunting firearms: with a rifled barrel – two units; smoothbore – two units;
2) self–defense weapons - two units, including smoothbore long-barreled firearms or gas pistols, revolvers or electric weapons.
These restrictions do not apply to collectible weapons.
Citizens of the Republic of Kazakhstan have the right to purchase gas pistols and revolvers, electric weapons for self-defense purposes with the right to store and carry them according to permits issued by internal affairs bodies.
2. Long-barrelled firearms, hunting airguns, throwing weapons (bows and crossbows), electric weapons, as well as gas pistols and revolvers purchased by a citizen of the Republic of Kazakhstan are subject to registration with the internal affairs bodies at the place of residence within one week from the date of purchase.
When registering smoothbore long-barrelled self-defense firearms, a citizen of the Republic of Kazakhstan is issued a five-year storage permit by the internal affairs body at his place of residence, and when registering hunting and sporting weapons, gas pistols and revolvers, throwing weapons (bows and crossbows), and electric weapons, a permit for their storage and carrying. The permit is issued for a period of five years.
The owner of the weapon applies to the internal affairs body at the place of registration of the weapon before the expiration of the permit to obtain a new one.
The permit form is approved by the authorized body in the field of arms control in coordination with the authorized body in the field of permits and notifications and the authorized body in the field of informatization.
3. In order to obtain a permit for the acquisition, storage, storage and carrying of weapons, a citizen of the Republic of Kazakhstan must submit to the internal affairs bodies at his place of residence an application in the prescribed form, a medical report on the absence of contraindications to the possession of weapons, established by the authorized body in the field of health, and a certificate of completion of a training and retraining program for owners and users of civilian and service weapons knowledge of the rules of safe handling of civilian and service weapons.
The list of medical contraindications, the procedure for passing a medical examination to obtain permits in the areas of circulation of civilian and service weapons, civilian pyrotechnic substances in accordance with the legislation of the Republic of Kazakhstan on permits and notifications, as well as its frequency are determined by the authorized body in the field of healthcare.
4. Persons who purchase smoothbore firearms for self-defense, gas pistols and revolvers, throwing weapons (bows and crossbows), electric weapons for the first time, with the exception of persons who have a permit to store or carry weapons, are required at their place of residence to undergo a knowledge test of the rules for the safe handling of civilian and service weapons in organizations designated by the authorized body in the field of arms control.
5. A state duty is charged for the issuance of permits for the acquisition, storage or storage and carrying, transportation, as well as certificates for the import into and export from the territory of the Republic of Kazakhstan of civilian and service weapons and ammunition in accordance with the tax legislation of the Republic of Kazakhstan.
6. Military personnel of the Armed Forces, other troops and military formations, with the exception of military personnel serving in the reserve, as well as employees of special state and law enforcement agencies, with the exception of state fire service agencies, who have special ranks and class ranks, receive permission to purchase civilian weapons without providing a medical opinion on the absence of contraindications to the possession of weapons.
The Law of the Republic of Kazakhstan dated December 30, 1998 No. 339.
This Law regulates legal relations arising from the turnover of civilian, service, military handguns and cold steel weapons in the territory of the Republic of Kazakhstan, and is aimed at protecting the life and health of citizens, property, ensuring public safety, protecting environmental facilities, resources, and developing international cooperation in combating crime and illegal proliferation of weapons.
The provisions of this Law also apply to the circulation of ammunition (cartridges).
