Article 15. The rights and obligations of officials of the authorized body in the implementation of state control in the field of motor transport of the Law on Motor Transport
1. Officials of the authorized body have the right to:
1) in cases and in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan, to stop motor vehicles at transport control posts in the territory of the Republic of Kazakhstan;
2) to carry out inspections and draw up acts on violations of the legislation of the Republic of Kazakhstan on motor transport, to give binding instructions on the elimination of violations;
3) to draw up protocols on administrative offenses, to conduct proceedings on cases of administrative offenses in accordance with the legislation of the Republic of Kazakhstan on administrative offenses;
4) request from individuals and legal entities the documents specified in Article 19-6 of this Law necessary for conducting an audit;
5) use technical means to record the facts of administrative offenses and actions of officials of the authorized body in accordance with the procedure determined by the authorized body.
2. Officials of the authorized body are obliged to:
1) to consider the appeals of individuals and legal entities regarding the activities of road transport and take appropriate measures on them;
2) to monitor compliance with the legislation of the Republic of Kazakhstan on road transport.
3. When exercising state control in the field of motor transport, officials of the authorized body must wear uniforms (without shoulder straps), have license plates, as well as official identification cards or identification cards.
The list of officials of the authorized body exercising state control in the field of motor transport who have the right to wear uniforms (without shoulder straps), samples of uniforms (without shoulder straps), license plates, service identification are approved by the authorized body.
The Law of the Republic of Kazakhstan dated July 4, 2003 No. 476.
This Law regulates the relations that arise between carriers, passengers, shippers, consignees, and other individuals and legal entities in the field of road transport.
