1. The victim has the right:

1) inform the insurer about the occurrence of an insured event that occurred as a result of the insured (insured) transportation of passengers and their property;

2) instead of the policyholder (insured), collect the documents necessary for making the insurance payment and submit them to the insurer with whom the policyholder (insured) has concluded a compulsory carrier liability insurance contract;

3) use the services of an independent expert to assess the amount of damage caused to health and (or) property;

4) to get acquainted with the results of the assessment of the amount of damage caused and the calculations of the amount of insurance benefit made by the insurer or an independent expert;

5) receive an insurance payment in the amount, procedure and terms established by this Law.;

 5-1) apply to the insurer or the financial ombudsman, or to the court, taking into account the specifics provided for in Article 24-1 of this Law, to resolve disputes arising from the carrier's compulsory liability insurance contract;

6) send the application and the attached documents to the financial Ombudsman (directly to the financial Ombudsman, including through his online resource, or through the insurer, including through its branch, representative office), taking into account the specifics provided for by the Law of the Republic of Kazakhstan "On State Regulation, Control and Supervision of the Financial Market and Financial Organizations";

7) to file a claim against the carrier for compensation of the damage caused in the amount exceeding the amount of the damage caused over the amount of the insurance payment received.

2. In the cases provided for by this Law, the rights of the victim established by paragraph 1 of this article shall be transferred to other persons acting as beneficiaries.

This Law regulates relations arising in the field of compulsory insurance of civil liability of the carrier to passengers, and establishes the legal, financial and organizational basis for its implementation.
