Article 16-1. The right of Kazakh and foreign vessels involved in subsurface use operations to repeatedly cross the State border of the Law on the State Border of the Republic of Kazakhstan
1. The right to repeatedly cross the State border is granted:
1) Kazakh and foreign vessels departing from ports, sea terminals or berthing facilities of the Republic of Kazakhstan to the waters of the Kazakh sector of the Caspian Sea in order to carry out work on the state geological study of the subsurface, exploration and extraction of minerals, as well as for the creation, use and operation of offshore facilities, floating drilling rigs with subsequent arrival in ports, sea terminals or berthing facilities of the Republic of Kazakhstan;
2) Kazakh and foreign vessels departing to the waters of the Kazakh sector of the Caspian Sea from sea checkpoints of the Republic of Kazakhstan or other places where passage across the State Border is carried out, in order to ensure subsurface use operations with subsequent arrival at sea checkpoints of the Republic of Kazakhstan or other places where passage across the State Border is carried out;
3) Kazakh and foreign vessels departing from ports, sea terminals or berthing facilities of the Republic of Kazakhstan to the waters of the Kazakh sector of the Caspian Sea in order to ensure subsurface use operations within the framework of projects identified as priorities by the Government of the Republic of Kazakhstan, with subsequent arrival at ports, sea terminals or berthing facilities of the Republic of Kazakhstan.
Kazakh and foreign vessels, in the cases established by the first part of this paragraph, may repeatedly cross the State Border without passing through border and other types of control on the basis of a permit from the Border Service of the National Security Committee of the Republic of Kazakhstan, provided that a self-propelled vessel has technical controls that ensure continuous automatic transmission of information about the vessel's location.
Customs operations related to the arrival or departure of vessels, in the case specified in the first part of this paragraph, are carried out in accordance with the customs legislation of the Republic of Kazakhstan.
2. Kazakh and foreign vessels specified in paragraph 1 of this Article are prohibited from:
1) entry into the territorial waters (sea) of a foreign state, into the internal waters of a foreign state, foreign ports;
2) disembarkation (boarding) of people, unloading (loading) of any cargo and goods on foreign and Kazakh vessels, in respect of which border control was carried out upon departure from the territory of the Republic of Kazakhstan, as well as those who did not pass border control upon arrival in the territory of the Republic of Kazakhstan, except in cases where this is caused by the need to rescue people and vessels or other extraordinary circumstances, about which the captain of the vessel immediately informs the Border Guard Service of the National Security Committee of the Republic of Kazakhstan.
3. The procedure for issuing permits for repeated crossing of the State Border by Kazakhstani and foreign vessels involved in subsurface use operations, as well as in ensuring subsurface use operations, the spatial and temporal limits of such permits, as well as the procedure for monitoring vessels specified in paragraph 1 of this Article, shall be established by the Government of the Republic of Kazakhstan.
