Article 16-4. Powers of the Cassation Court of the Constitutional Law on the Judicial System and the Status of Judges of the Republic of Kazakhstan
The Court of Cassation:
1) considers court cases and materials as a court of cassation instance;
2) studies judicial practice and, based on the results of its generalization, considers issues of compliance with the rule of law in the administration of justice by lower courts;
3) exercise other powers provided for by law.
Article 16-5. Chairman of the Court of Cassation
1. The Chairman of the Court of Cassation is a judge and, along with performing the duties of a judge:
1) decides on the organization of legal proceedings in court;
2) convenes and presides over the plenary sessions of the Court of Cassation;
3) ensures that the plenary session of the Court of Cassation discusses the issue of giving recommendations to the Judicial Jury on whether or not to bring the chairman of the judicial board, the chairman of the regional court, and the judge of the Court of Cassation to disciplinary responsibility for gross violations of the law when considering court cases, as well as sending materials to the Judicial Jury within the time limits established by the legislation of the Republic of Kazakhstan;
4) ensures the work on combating corruption and compliance with the norms of judicial ethics;
5) approves the work plan of the Court of Cassation;
6) organizes the study of judicial practice;
7) issues orders;
8) conducts a personal reception for citizens;
9) exercise other powers provided for by law.
2. In case of early termination or expiration of the term of office of the chairman of the cassation court, the Chairman of the Supreme Court shall temporarily perform the duties of the chairman on one of the judges of this court.
3. In case of temporary absence of the chairman of the cassation court, the performance of duties is assigned to one of the judges of this cassation court by order of the Chairman of the cassation court.
4. The Chairman of the Supreme Court has the right to cancel the assignment of duties provided for in paragraphs 2 and 3 of this Article and assign the duties of the chairman of the cassation court to another judge of this cassation court.
