Article 16. Formation of the list of the Law On Concessions - Excluded by the Law of the Republic of Kazakhstan | KYRGYZSTAN alynyp tastaldy.

1. The list is formed by the central authorized body for state planning for republican-owned facilities and the authorized bodies of the region, the city of republican significance, and the capital for state planning for concession facilities related to communal ownership, based on a positive expert opinion on competitive (auction) documentation of concession projects and in accordance with strategic and program documents of the Republic of Kazakhstan., with the investment opportunities of the republican and (or) local budgets annually for a period of three years on a rolling basis.

2. The list consists of two sections:

1) existing state-owned facilities, the reconstruction and operation of which will be carried out on the basis of a concession agreement;

2) facilities, the creation and operation of which will be carried out on the basis of concession agreements.

3. Excluded by the Law of the Republic of Kazakhstan dated 03.12.2013 No. 150-V (effective from 01.01.2014).

4. For objects not included in the list, the relevant notifications are sent to the state bodies that submitted the relevant proposals, with a reasoned justification for their non-acceptance.

5. The objects of the concession that have not been transferred to the concession are included in the corresponding list, which is being formed for the next medium-term period.

The Law of the Republic of Kazakhstan dated July 7, 2006 No. 167.

This Law defines the legal conditions of the concession, the types of state support for the concessionaire, and regulates public relations arising in the process of concluding, executing, and terminating concession agreements.
