Article 16. Rights and obligations of independent experts and consultants Chapter 4. Organization of State monitoring of Property of the Law on State Monitoring of Property in Sectors of the Economy of Strategic Importance

      1. Independent experts and consultants engaged to perform certain types of work on state monitoring of property are individuals and legal entities engaged in professional research, consulting, development of conclusions and recommendations in the field of legal, financial, economic, socio-economic, environmental, industrial, technical and technological analysis, with relevant knowledge and by experience.  

      2. Independent experts and consultants during the state monitoring of property have the right:  

      1) get the necessary information about the monitoring object;  

      2) directly inspect the monitoring facility in accordance with the monitoring plan and program;  

      3) access to the documentation necessary for the implementation of state monitoring of property.  

      3. Independent experts and consultants are required to carry out state monitoring of property.:  

      1) comply with the requirements of the legislation of the Republic of Kazakhstan on state monitoring of property;  

      2) conduct a comprehensive, objective and qualitative analysis, prepare a reasoned report and conclusion;  

      3) not to disclose information constituting a legally protected secret that has become known during state monitoring of property;  

      4) ensure the safety of the documents and materials transferred to them.  

      4. The terms of the agreement may provide for other rights and obligations of independent experts and consultants.  

 

The Law of the Republic of Kazakhstan dated November 4, 2003 No. 490.

      This Law regulates public relations arising in the process of state monitoring of property in sectors of the economy of strategic importance, and also defines the grounds and conditions for its implementation.
