Article 161. Appeal, filing by the prosecutor of a petition for rulings on the issues of securing a claim of the Civil Procedure Code of the Republic of Kazakhstan

1. A private complaint may be filed against the rulings on the issues of securing a claim, or a petition may be brought by the prosecutor to the court of appeal, whose decision is final.
2. If the ruling on securing the claim was issued without notifying the person who filed the complaint, the time limit for filing the complaint is calculated from the day when he became aware of this ruling.
3. Filing a private complaint against a ruling on securing a claim does not suspend the execution of this ruling.
4. The filing of a private complaint, the filing by the prosecutor of a motion to cancel the claim security or to replace one measure of claim security with another, suspend the execution of the ruling.
5. With a private complaint to the court of appeal, the material extracted from the case concerning the adopted definition is sent.
