Article 17. Insured event of the Law On Compulsory Environmental Insurance
1. An insured event under a compulsory environmental insurance contract is recognized as the occurrence of the insured's civil liability for the elimination (remediation) of environmental damage caused as a result of an accident.
2. The proof of the occurrence of the insured event, as well as the losses caused by it, lies with the policyholder (beneficiary).
3. In case of refusal of the insurer to make an insurance payment, the insured event is considered to have occurred from the date of entry into force of the court decision on the elimination of environmental damage caused by the policyholder.
4. The amount of the insurance payment is determined by the insurer based on the cost of eliminating (remediating) environmental damage, taking into account the provisions of paragraph 2 of Article 7 of this Law.

This Law regulates public relations arising in the field of compulsory environmental insurance and establishes the legal, economic and organizational basis for its implementation.
