Article 17. The agreement on the transfer of children to the family of the Children's village of the Law on Family-type Children's Villages and Youth Homes

Article 17. The agreement on the transfer of children to the family of the Children's village of the Law on Family-type Children's Villages and Youth Homes

     1. The child transfer agreement must contain:

     1) conditions of upbringing, education and maintenance of children's village pupils;

     2) the rights and duties of the mother-educator, the administration of the children's village;

     3) the duties of guardianship and guardianship authorities in relation to foster mothers;

     4) the grounds and consequences of termination of the child transfer agreement.

      Children are placed in the care of a foster mother for a period until they reach the age of eighteen.  

      2. Early termination of the agreement on the transfer of children to the family of the children's village may be carried out in the following cases::  

      1) the presence of valid reasons (illness, change of marital status and other cases of inability to perform their duties) on the initiative of the mother-educator;  

      2) evasion by the mother-educator from fulfilling the duties assigned to her, abuse of her rights, abuse of children, including physical or mental violence against them, and in other cases of unfavorable conditions for the maintenance, upbringing and education of children at the initiative of the guardianship and guardianship authority and (or) the administration of the children's village;  

     3) the return of the child (children) to the parents or his (their) adoption, as well as the transfer of the child (children) to guardianship (guardianship), foster care;

      4) violations of the terms of the agreement on the transfer of children to a family.  

     3. In case of early termination of the agreement on the transfer of children to the family of the children's village on the initiative of the mother-caregiver, such an agreement is concluded by the guardianship and guardianship authority with the administration of the children's village and a person who is in the personnel reserve of mothers-caregivers.

 

 

The Law of the Republic of Kazakhstan dated December 13, 2000 No. 113-II.

     This Law defines the legal status of family-type children's villages and youth homes established in order to meet the rights of orphaned children and children left without parental care to live and be raised in a family, as well as to comprehensively ensure their moral, spiritual, labor upbringing and education.
