1. In order to save energy and improve the energy efficiency of the energy resources used, individuals and legal entities, including government agencies and quasi-public sector entities, may conclude energy service contracts with energy service companies.

Government agencies conclude energy service contracts in accordance with a standard energy service contract for government agencies for a period of no more than six years.

2. The energy service agreement must contain the following conditions::

1) on the amount of energy resource savings to be provided by the energy service company as a result of the execution of the energy service agreement;

2) on the validity period of the energy service agreement, which must be at least the period necessary to achieve the amount of energy savings established by the energy service agreement.;

3) payment for work at the expense of funds received from the annual savings of used energy resources.

The price under an energy service agreement should be determined based on the indicators achieved or planned to be achieved as a result of the implementation of the energy service agreement, including based on the cost of energy resources saved or from savings in energy resources generated by reducing specific energy consumption per unit of production.

3. The energy service agreement may contain a condition on the obligation of the energy service company to ensure, when executing the energy service agreement, the regime, conditions of consumption (use) of energy resources agreed by the parties (including temperature, light level, other characteristics that meet the requirements in the field of labor organization, maintenance of buildings, structures, structures), regime, conditions of production, transfer of energy resources, etc. other agreed terms.

This Law regulates public relations and defines the legal, economic and organizational foundations of the activities of individuals and legal entities in the field of energy conservation and energy efficiency improvement.
