Article 18. Confidential assistants providing assistance to bodies engaged in counterintelligence activities of the Law On Counterintelligence Activities

Article 18. Confidential assistants providing assistance to bodies engaged in counterintelligence activities of the Law On Counterintelligence Activities

     1. Confidential assistants who assist bodies engaged in counterintelligence activities are protected by the State.

     2. It is not allowed to provide anyone with information about the identity of confidential assistants.

     3. In the event of a real threat of encroachment on the life, health or property of confidential assistants, as well as members of their families and close relatives, the body carrying out counterintelligence activities is obliged to take all necessary measures to prevent illegal actions, identify the perpetrators and bring them to justice, as well as, if necessary, security measures in accordance with the legislation of the Republic. Kazakhstan on State protection of persons involved in criminal proceedings.

     4. Confidential assistants provide assistance to bodies engaged in counterintelligence activities on a paid or gratuitous basis. The procedure for paying remuneration to confidential assistants who provide assistance on a reimbursable basis is established by the first head of the body engaged in counterintelligence activities.

     5. In the event of the death of a confidential assistant in connection with his participation in conducting counterintelligence activities, a one-time allowance is paid to the family of the deceased and his dependents in the amount of:

     ten annual amounts of monetary compensation for the deceased who collaborated on a paid basis;

     1,411 times the monthly calculation index established by the law on the republican budget and effective on January 1 of the relevant fiscal year, with the cooperation of the deceased on a gratuitous basis.

     6. If a confidential assistant receives injury or other harm to health in connection with his participation in counterintelligence activities, he is paid a one-time allowance in the amount determined by the first head of the body carrying out counterintelligence activities, which should not exceed:

     five annual amounts of monetary remuneration for paid collaborators;

     706 times the monthly calculation index established by the law on the republican budget and effective on January 1 of the relevant fiscal year, for cooperating on a pro bono basis.

     7. Payment of a one-time allowance in cases of death of a confidential assistant or injury or other harm to health in connection with his participation in conducting counterintelligence activities is made from the funds of the body carrying out counterintelligence activities, in accordance with the procedure determined by the regulatory legal act of the body carrying out counterintelligence activities.

     8. The organization and procedure for working with confidential assistants are established by regulatory legal acts of the body engaged in counterintelligence activities.

 

 

The Law of the Republic of Kazakhstan dated December 28, 2016 No. 35-VI SAM.

     This Law defines the legal basis of counterintelligence activities and the system of guarantees of legality of their implementation.
