Article 18. Examination of the applicant at the location of the Law on Accreditation in the field of Conformity Assessment

Article 18. Examination of the applicant at the location of the Law on Accreditation in the field of Conformity Assessment

      1. The examination of the applicant at the location is carried out in order to assess the applicant's competence and the compliance of the information provided in the documents with the actual condition.  

      2. The examination is carried out by an expert auditor for accreditation or a survey team formed by the accreditation body.  

      3. The examination group must consist of at least two people, the head of the group is appointed an expert auditor for accreditation, who conducted the examination of documents.  

      4. The survey team may be included by agreement.:  

      experts-conformity assessment auditors, technical experts, specialists from government agencies and other organizations in the declared field of accreditation.  

      5. The examination period should not exceed ten working days, calculated from the moment of arrival of the examination team at the location of the applicant or its structural unit located outside the location of the applicant. The total period of examination of an applicant with structural divisions should not exceed thirty working days.  

      6. Based on the results of its work, the survey team draws up a report that should contain an assessment of the applicant's compliance with the accreditation criteria.  

      7. The report is compiled by the head of the group, taking into account all the comments of its members, in two copies and signed by all members of the group. One copy of the report is given to the applicant.  

      8. In case of disagreement with the report of the examination group, the applicant may submit his comments in writing to the accreditation body within three working days by mail or fax and is considered received, respectively, from the date of the mark of the accreditation body in the notification of receipt of the mail or on the day of sending the fax message.  

      9. Based on the report of the examination group and taking into account the applicant's comments (if any), the accreditation body shall make one of the following decisions within no more than five working days:  

      1) review of the collected accreditation materials;  

      2) on the elimination of the identified inconsistencies by the applicant.  

     The notification of the decision is sent to the applicant in writing within three working days from the date of the decision by mail or fax and is considered received, respectively, from the date of the applicant's mark in the notification of receipt of the postal item or on the day of sending the facsimile message.

     10. The applicant, within twenty working days from the date of receipt of the notification specified in subparagraph 2) of the first paragraph of paragraph 9 of this Article, shall eliminate the inconsistencies identified during the examination and notify the accreditation body of their elimination in writing by mail with the submission of supporting documents on the elimination of inconsistencies, after which the accreditation body, if necessary, conducts a re-examination.. The period of repeated examination of the applicant or his structural subdivision should not exceed five working days, calculated from the moment of arrival of the examination team at the applicant's location.

      11. The deadline for the elimination of inconsistencies is extended by the accreditation body based on the applicant's written or electronically transmitted application through the technical regulation information system, in which he indicates the reasons, but not more than two months.

     This Law regulates public relations in the field of accreditation of conformity assessment bodies, as well as related relations.
