Article 18. Forced crossing of the State Border of the Law On the State Border of the Republic of Kazakhstan
1. It is not a violation of the procedure for crossing the State Border if it is forced to cross (outside of designated locations, sea or air corridors) due to the following exceptional circumstances:
1) natural disaster, disaster, accident, emergency situation and in other cases threatening the life or health of people, the safety of a Kazakh or foreign vessel, a foreign warship, a means of transportation on ice, as well as an aircraft;
2) towing a damaged Kazakh or foreign vessel, a foreign warship, or a means of transportation on ice;
3) delivery of rescued people;
4) providing urgent medical assistance to a crew member or passengers of a Kazakh or foreign vessel, a foreign warship, or a means of transportation on ice.
2. The captain (boatmaster) of a Kazakh or foreign vessel, a foreign warship, a means of transportation on ice, and the commander of an aircraft in case of forced crossing of the State Border or forced non-compliance with the procedure established by this Law for traveling from the State Border to checkpoints or in the opposite direction must:
1) immediately notify the administration of the nearest Kazakh sea or river port, airport or airfield, which immediately notify the Border Guard Service of the National Security Committee of the Republic of Kazakhstan and the Ministry of Defense of the Republic of Kazakhstan;
2) act in accordance with the instructions of the authorized bodies, the commander of a border or military ship of the Republic of Kazakhstan, the captain of a sea, river vessel or the commander of an aircraft of the Republic of Kazakhstan, who arrived to provide assistance or clarify the circumstances of the incident.
3. Other persons and vehicles in case of forced crossing of the State Border or forced non-compliance with the procedure defined by this Law for traveling from the State Border to checkpoints and back are obliged to:
1) immediately notify the management of the nearest territorial subdivision (structural subdivision) of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan;
2) act according to the instructions of a representative of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, who arrived to clarify the circumstances of the incident.

This Law regulates public relations in the field of protection of the State border of the Republic of Kazakhstan.
